PC 79-103i ~., r ' RESOLUTION Nb. PC79'103 A RESOLUTION OF THE ANAHEIM CITY PLANNIN6 COMNISSIOH GRANTIN6, IN PART. THE REQUEST FOR DELETION OF COPaDITI0N5 NOS. 1 ANO 4 PERTRINING TO PAYMENT OF THE TRAFFIC SIGNAL ASSESSMENT FEE AND THE RESTRICTION ON OUTDOOR USES IN CONNECTION WITH CONDITIOHAL USE PERMIT N0. 1921 NHEREAS, the petitioner submitted a request for an amendment to the conditions of approval contained in City Planning Commission Resolution No. PC78-289 adopted in connection wtth Condltional Use Permit No. 1921 on property consisting of approximately 0.6 acre on the souch side of Embassy Street, havtng a maximum depth af approximately 205 feet, being located approximately 440 feet east of the center- llne af Loara Street; and WHEREAS, the petitioner requests deletion of the folloHing conditfons contained in the above-referrsd to resolution of the City Planning Commission: Condition No. 1-"That the owner(s) of subject property shall pay the traffic signal assessment fee (Council Policy No. 214) difia~a~ce betv+een tndustrial and commercial use at a ratio of 5150.00 per 1000 square feet of building or fraction thereof prior to the issuance of a building pertnit or w?thin a period of sixty (60) days, whichever occurs first." WHEREAS, the Anaheim City Plannin9 Commisston did hold a public hearing at the City Hali in the Gity of Anaheim on May 21. 1979, at 1:30 p.m., notice of said public hearing having been duly given as required by law and in accordance with the provisions of the Anaheim Municipal Code, to hear a~d consider evidence for and against said proposal to amend the conditions of approval of Conditional Use Permtt No. 1921, and to investigate and make findings and recamr~endations in connection thcrewiih; and WHEREAS~ said Commission, after due inspection, investigation and study made by itself and in its behalf, and after due consideration nf all evidence and reports offered at said hearing, DOES HEREBY FtNO: t. That no one indicated their presence in opposition at said public hearing, and that na correspondence was recetved in opposition to the subJect ~-eq ues t. 2. That the petitioner submitted evidence at the public hearing which indicates the use of this facility is accessory to Southland Chevrolet and that all detailing work performed at subJect location is for that automobile dealership and no retall work is performed for private customers. 3. That after Condition No. 4~ pertaining to the restriction o~ outdoor storage and outdoor work, was clarified to the petitioner as being applicable only to the specif(c use perm(tted in connection with Conditional Use Permit No. 1921, said petitioner withdrew hts reques[ for deletion of Condition No. 4, PC79-~o3 ;- ~. ) ENVIRONMENTAL IMPACT FINDING: A Negative Declaration was previously approved in conJunction with subJect Conditional Use Permtt. NOW, THEREFORE~ BE iT RESOLVEO tha[ the Anaheim City Planning Commission does hereby yrant the request to deletc Condition No. 1 pertaining to payment of the traffic signal assessment fee stnce the use is more industrial in nature than commercial, and does hereby deny the reouest for deletion of Condition No. 4 pertaining to restriction of outdoor storage and outdoor work because the petitioner withdrew his request at the public heari~g.
