NHEREAS, the City Pianning Cormission did hold a publtc hea~Ing at the CTty Hatl Tn the ~ity of Anahelm on June 18~ 1979~ at 1:30 p.m.~ notice of sald public heart~g having bean duly given as requlred by lao~ and in accordance with the provTsions of the Anahelm Munictpal Code, Lhapter 18.03, to hear and consider Pc79->>5 evidence for and against sald proposed reclassiflcatton and to Investigate and make findings and recortmendations in connection therevrith; and WIiEREAS, said Commission, after due inspection, invr.sttgation and study made by itself and tn its behalP, and after due considera[Ion of all evidence and reports offered at said hearing, does find and determine the following facts: i. That the pe[itioner proposes reciassification of subject property fran che CG (Commerical, General)~ CL (Comercial, Limlted) and PD-L (Parking District- CorrxnercTal) Zones to the CO (Commercfai, Offtce) Zone. 2. That the Anahein General Plan designates subJec[ property for gencral cormierctal land uses. 3. That the proposed reclassification of sub;ect property is necessary and/or desirable for the orderly and proper devclopment of the community. 4. That the proposed reclassificatlon of subJect property dces properly relate te the zones and their permitted uses locally established in close proximity to subJect property and to the zoncs and their pcrmitted uses generaily established throughout the cormunity. $. BE IT RESOLVED that the A,iahcim City Planning Commission does hereby grant subject Pe[itton for Reclassificatlon and, by so doing. that Ti[le 18-Zoning of Che Anaheim Huniclpal Code be ~mended Lo exclude the abovr_-descrlbed property from the LG (COHMERCIAL, GENERAL). CL (CQ'1MERCIAL. LIMITED) and PO-t (PARY.ING DISTRICT-COhIMERCIAI) 7'OHES and to Incorporate said described property tnto the CO (COMNERCIAL. OFFILE) ZONE upon the following conditions which are hereby found to be a necessary prerequisite to the proposed use of subject property T~ order to preserve the safety and generat welfarc of the Cttizens of the City of Anaheim: i. That strect ligh[ing facllities along Helena Strer.t and Charcres Street shal) be installed as required by ehe Director o` Public Utllities, and In accordance with spectfications on file in the Office of the Director of Public Utillties; and/or that a bond, certificate of deposit, letter of credlt, or cash~ ln an amou~t and form sattsfac[ory to the City of Anaheim shall be posted with the City to guarantee the installation of the above-mentioned requirelne~ts. 2. That subJect property shall be deieloped substantlally in accordance with plans and specificattons on file wtth the City of ~naheim marked Exhibtt Nos. 1 through 4; provided. however, that any modificatlon to the plans shall be submit[ed to the Planning Commission for their approval prlor to issuance of a building permit. 5. That all roof-mounied equlpment shall be fully vicw-screcned and sound- buffcrcd from adjacent properties. 6. That the uses Tndicated on Exhibit No. 1(corporate offices and general offices) shall not be modified in such a way as to Tncrease che requtred parking beyond thc number of spaces provided. 7. Prlor to the introduction of an ordinance rezoning subJect pro~erty. Condition Nos. 1 and 3, above-mentloned, shall be complcted. The provisions or rights granted by thfs resolution shall become null and voTd by actlon of the Planning Corriission unless said conditlons are complled with within one year from the datc hereof, or such further tinc as thc Planntng Corrriission nay grant. 8. That Condition Nos. 2, 4 and 5, above-nentloned, shall be conplted with prior to final building and zoning inspections.
