GfiEREAS, the Ciiy Planning Commission did hold a public hearing at the City Hall in the City of Anahein on June 18, 1979, at 1:3Q p.m., notice of sald public hearing having been duly aiven as required by law and tn accordance Nith the provisions of the Anaheim Nunicipal Code, Lhap[er 18.03. to hear and constder evidence for and agalnst sald proposed condittonal use and to investigaCe and make findings and recommendatlons ln connectlon thereHith; and ~1HEREAS~ sald Commission, after due inspcctton, investigation and study made by itseif and in its behalf, and after due consideration of all evidence and reports oFfered at sald hearing, does find and deternine thc following facts: 1. That the proposed use Is properly one for Hhich a condi[lonal use pernit is authorized by Anaheim Munic(pal LoJe Seccion 18.1+5•~50.060 to wi[: to permit an aucomobile sales lot. 2. That [he proposed use is hereby granted for a perlod of six (6) months. subject to review by the Planning Cor,mission for passible extensions of time if it is determined that tne use has not had a detrimental effect on the surrounding area. 3. That the petttioner Tndicated the automobile sales activities wlll typTcaily be conducted on Saturdays and Sundays only a~d that the used cars a•ill be parked there for display purposes by their a+ners and will not be removed durin9 the weekdays. 4. That the proposed use Ts hereby granted subjec[ to the condition that a four (4) foot wide tandscaped planter with permanent Irrigation facilitles shall be provided along West S[reet fron[age and tha[ a similar landscaped planter Island be provided near the driveway on Llncoln Avenue and also that the existing bullding 6e recondltioned, 5. That the prop~sed use will not adversely affect the adjolrting land uses and the growth and development of the area in which it is proposed to be located. 6. That the size and shape of the site proposed for the usc fs adequate to allow the full development of the proposed use in a manner not detrimental to the PC79->>9 particular area nor to the peace, health, safe[y, and general welfare of the Cittzens of the City of Anaheim. 7. That the granting of the Conditional Use Permit under the conditions lmposed, if any, will no[ be detrimental to the peace, health, safety and general weifare of the Citizens of thc City of Anaheim. 8. That no o~e indica[ed their presence ai sald public hearing in opposition; and that no correspondence was recetved in oppositton to the subject petition. EtIViRONMEN7AL IMPALT FINDING: That the Anahein Ctty Planning Commission has reviewed the proposa to permit art automobite sales lot on an irregularly-shaped parcel of land consisting of approximately 0.5 acre located at the northeasc corner of Lincoln Avenue and West S[reei, having approximate frontages of 190 feet on the north side of Lincoln Avenue and 65 feet on the eas[ side of '.lest Street; and does hereby approve Che Nega:ive Declaration from the requtrement to prepare an environmental impact report on the basis that there would be no significant individual or cumulative adverse environmental lmpact Jue. to the approval of [his Negative Declaration since the Anaheim General Pian deslgnates the subject property for general cortmercial la~d uses commensurate with the proposal; that no sensitive environmental impacr.s are involved in [he proposal; that the InitTal Study submitted by the petitioner indicates no significan[ tndividual or cumulative adverse environmental impacts; a~d that the ~~egative Declaration substanttating Che foregoing findings is on file in the City of Anaheim Planning Department. NOll, THEREfORE, BE IT RESOLVED that the Anaheim Ci[y Planning Commission does hereby grant subjec[ Petition for Conditional Use Pcrmit, upon thc following conditions which are hereby found to be a necessary prerequisite to the proposed use of [he subject property in order to preserve the safety and gencral welfare of ihe LtLizeRS of ,he City of Anahelm: i. That the easterly and westerly driveways on Ltncoln Avenue and the driveway on West Street shall be removed and replaced Hi[h a standard curb, gutter and sidewalk. 2. That trash storaqe areas shall be provided )n accordance with approved plans on file with the Office of the Director of Public korks. 3. That thc underground gasoline storage [anks shall be sealed and locked prlor to the ccxnmencement of the activity authortzed under this resolutton. and that within 30 days aftcr one year fram the date of approval of this permit, the underground tanks shall be removed. 4.
