WHEREAS, the City Planning Commission did hoid a pubiic hearing at the City Hali in the City of Anaheim on July 1G, 1979, a[ 1:30 p,m., notice of said public hearing having been duly given as required by law and in accordance wi[h the provisions of the Anaheim Municipal Code, Chap[er 18,03, to hear and consider evidence for .:nd a9ainst said proposed conditional use and to investigate and make flndings and recommendations in connection [herewith; and WHEREAS, said Ca~mission, after due inspection~ i~vestiga:ion and study made by itself and in its behalf, and after due cons?deration of all evidence and reports offered at said hearing, does find and determine the following facts: 1. That the proposed use is properly one for which a condittonaluse permit is authorized by Anaheim Municipal Code Sectlon 18.44.050.160 to wit: to permit a 20-unit expansion of an existing motel. 2. That the proposed use ~iill not adversely affect the ad)oining la~d uses and the growth and devetonment of the area in which it is proposed to be located. 3, That the size and shape of the site proposed for the use is adequats to allow the full development of the proposed use in a manner not detrlmental to [he particular area nor to the peace, health, safety, and gPneral welfare of the Citlzens of the City of Anahafm, PC79-146 4. That the granting of the Conditional Usc Permit undcr the conditions imposed, if any, will not be detrimental to the peacc, health, safety and general welfare of the Citizens of the City of Anahelm, 5. That the traffic 9enerated by the proposed use orill not impose an undue burden upon the s[reets and highways designed and improved eo carry the traffic in the area. 6. That no one indicated their presence at said public hearing in opposition; and that no correspondence was recelved in oppos(tian to the subJect petitton. EtJVIRONMEI~TAL IMPACT FINDING: That the Anahelm Ci[y Pianning Commission has reviewed the proposa to permit a 20-unit expansion to an existing motel located on an irregularly-shaped parce! of land conslsting of approximately 1.1 acres having a frontage ef 94 fee[ on the east side of Deach Boulevard, having a maximum depth of 375 feet, and being located 338 feet north of the centeriine of Bail Road; and does hereby :,pprove the Negative Declaration from the reguirement to prepare an envlrcr~mental impact report on the basis that there would be no significant individual or cumulative adverse environmental impac[ due to the approval of this Negative Declaratton since the Anaheim General Plan designates the subJect property for general commercial land uses cortr,iensurate with the proposai; that no sensitive environmental impacts are Involved i~ the proposal; that the Initiai Study sub~ttted by the pe[itioner indica[es no significant individual or cumulaiive adverse environmental impacts; and that the Negat(ve Declaration substantiating [he foregoing findin9s is on file in the Ctty of Anaheim Planning Department. NOW, TNEREFORE, BE IT RESOLVED tha[ [he Anahelm City Planning Camnission does hereby grant subject Petition for Conditfonal Use Permit, upon the following c~nditlons which are hereby found to be a necessary prerequisite to the proposed use of the subjec[ property in order to preserve the safety and general welfare of the Citizens of the City of Anahelm: 1. That strest lighting facilfties along Beach Boulevard shall be Ins[alled a~ requlred by the Dfrector of Public Utilitles, and tn accordance with specifications nn file in the Office of the Director o` Pubiic Utilities; and/or ihat a bond, certificate of depostt, letter of credit, or cash, in an amount and form satisfactory to the City of AnahPim sFial) be posted Nith the City to guarantee the installation of the above-mentioned requiremenes prior to occupancy. 2. That trash storage areas shall be provided tn accordance with approved plans on file wiih the Office of the Director of Public Works. 3. That ftre hydrants shal( be Installed and charged as required and determined to be ~ecessary Ey the Chief of the Fire Department prior to commencement of structural framing. 4. That subject property shall be served by underground utilitles. S. That dralnage of subJect proper[y shall be disposed of in a manner satisfactary to the City Engineer. -2- pC79-146 6. That subJect propcrty shall be developed suhstantially in accordance with plans and specificatlons on flle with the Clty of Anaheim marked Exhiblt Nos. 1, 2 and 3; and/or provided; however, that ki[chen efficiency units may conslst of a maxim~m of 6-cubic foot refrtgerators, two-burner stoves excluding oven and baking facilittes. and single compartment sinks except that the manager's unit will be allowed to have full kitchen facitities. 7. That the owner(s) of subject property shall pay the traffic signal assessment fee (Ordinance Ho. 3896) in an amouni as determined by [he Li[y CouncTl, for each new motel unit prior to the issuance of a buitding permit. 8. Tha[ the orrner(s) of subJect property shall ftnalize the CL (Commercial, Limited) zoning on subJect property pr(or to the issuance of a building permit. 9, That Conditlon Nos. 1 and 8, above mentloned, shal? be complled wtth prior tothe issuance of a building pcrmit or within a period of one year from the date hereof, whichever occurs first, or such further ttme as the Planning CommTss(on may gran[. 10. That Cor.dition Nos. 2, ~, 5 and 5, above-mentioned, shall be complied with prior to final buitding and zoning inspections. BE IT FURTHER RESOLVED that the Anaheim City Plann(ng Commissior does hereby find and determine that adoption of this Resolution is expressly predicated upon applicant's compliance with each and all of the condittons hereinabove set forth. Should any such condition, or any par[ thereof, be declared lnvalid or unenforceable by the final Judgment of any couri of competent jurisdiction, [hen this Resolution, an~ any approvals herein contained, shall be deemed nutl and void.
