RESOLUTION NO. 71R- 115
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM COMPROMISING CERTAIN EMINENT DOMAIN
LITIGATION, ACCEPTING A CERTAIN EASEMENT DEED,
AND AUTHORIZING AND DIRECTING PAYMENT THEREFOR.
WHEREAS, heretofore, on the 22nd day of February, 1971,
suit was filed in eminent domain to acquire an easement for road
and public utility purposes in connection with the improvement
of Brookhurst Avenue, being entitled, "City of Anaheim vs. Paul J.
Knaak, et ux., et al.," Orange County Superior Court No. 181250;
and
WHEREAS, the defendants have offered to settle said
litigation for the total sum of $51,100.00; said sum being com-
patible with the City of Anaheim's appraisal and being fair and
reasonable: and
WHEREAS, said defendants have tendered to the City of
Anaheim their deed to the property sought to be condemned and the
City Council finds that it is in the best interests of the City
to compromise said litigation and accept said deed.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that it accept and it does hereby accept
the easement deed of Paul J. Knaak and Ruth E. Knaak, covering
the property sought to be condemned and that the City Clerk be
and she is hereby authorized and directed to cause said deed to
be recorded.
BE IT FURTHER RESOLVED that the City Council authorize
and direct, and it does hereby authorize and direct, the .settle-
ment of said eminent domain Ii tigation for the sum of $51,100..00
and that the Finance Director be and he is hereby authorized and
directed to draw a warrant in said sum in favor of Paul J. Knaak
and Ruth E. Knaak; that said warrant be delivered to the Office
of the City Attorney for transmittal.
THE FOREGOING RESOLUTION is approved and signed by me
this 23rd day of March, 1971.
