hearing having been duly given as requfred by law and Tn accordance with the
provtsions of the Anaheim Municipal Code, Chapter 18.03. to hear and cons(der
evidence for and against said proposed variance and to lnvestigate and make fTndings
and recommendations in connection therewtth; and
WHEREAS, said Corsmtssion, after due inspection. investigation and study made
by itseif and fn its behalf~ and after due consideration of alt evidence and reports
offered at said hearing~ does find and determine [he follavTng facts:
1. That the proposed use is properly one for which a condl[tona) use
permtt is authorized by Anaheim Municipal Code Section 18.~3.03D.010 to Ni[: Co
permit a contractor's storage yard in the RS-A-L3,000 Zone with a walver of:

the noise, trafftc~ parking~ obnoxious fumes and other disturbances generated by the
existtn9 illegal use on a 24-hour basTs have had a detrimental affect on the
surrounding resTdenttal area and are Tncompatible with the nearby and adJacent
residential uses.
3. That the proposed use will adversely affect the adJoining land uses and
the growth and development of the area in NhTch it is proposed to be located.
4. That the stze and shape of the slte proposed for the use is not
adequate to allow the ful! development of the proposed use Tn a manner not
detrimental to the parttcular area nor to the peace~ heaith~ safety. and generat
welfare of che Citizens of the Ctty of Anahetm.
5. That the granting of the Conditional Use Permit will bc detrTmental to

of Ball Road, having a maximum depth of r~~proxlmately 211 fect, being located
approxlrnately 1145 feet aest of the centerline of Beach Boulevard; and does hereby
disapprove the Negativc Declaratlon frpn the requirement to prepare an envlronmertal
Tmpact report ort the basls that there ~+ould be sionlficant Tndividual or cumulative
adverse environmental impacts due to the approval of thTs Negative Declaration.

aforementioned findings.
