ENVIRONMENTAL 114PACT FINDING: Tha[ the Anaheim Ctty Planning Commission has reviewed the proposal to permi[ a church wi[h accessory school Pactltties wtth walver of maximum structural height on an irregularly-shaped parcel of land conslsting of approximately 5 acres located at the southwest corner of Santa Ana Lanyon Road and Solomon Orive, having approximate frontages of 3~B feet on the south side of Sa~[a Ana Canyon Road, ~015 feet on Che Nest side of Solomon Drive, and 11° feet on the north side of Cicero Road; and does hereby approve the Negative Declaration from the requirement to preparc an environmental impac[ report on the bas(s that there would be no signiftcant individual or cumulative adverse envtronmenta) impact due to the approval of this Negative Declaration since the Anahelm General Plan designates the subject property for low density residenttal land uses commensurate with the proposal; tha[ no sensitive environmenCal impacts are }nvolved 1rt ttie propo;al; that the Initfal StuJy submftted by the petitioner indicates no significan[ individual or cumulative adverse envirornnental Impacts; and tha[ the Negattve Declaration substantiating the foregoing findings is on fite in the City of Anaheim Planning Department. NOW, THEREFQRE. BE IT aE50LVED that the Anaheim City Planning Commisslon does hereby gran[ subJect Petition for Londitional Use Permft, upon the following condittons which are hereby found to be a necessary prerequisite to [he proposed use of the s~bject property in order to preserve the safety and generai wclfare of Che Citizens of thc Clty of Anahetm: 1, That sidewalks shall be installed along Solomon Drive as required by the City Engineer and in accordance with standard plans and specifica[tons on ftle In the Offtcc of the Clcy Engineer, 2. That street lighting facitities along Solomon Drive shall be installed prfor to [he final building and zoning inspections unless otherwise approved by thc Director of Publlc U[ilitles, ~nd in accordance with specif(catlons on file ln the -2- PC7S-6o ~` 5 Office of the Director of Public Utilities; and/or [hat a bond, certiftcate of deposit, letter of credit, or cash, 1~ an amount and form satisfactory to the City of Anaheim shall be posted with the City to 9uarantee the installacfon of the above- mentioned requirements. 3. That the owner(s) of subJect property sFiall pay to the City of Anaheim a fec, in an amount as determined by the City Council, for tree planting purposes along Solanon Drtve. 4. That trash storage areas shall be provfded in accordance with approved plans on file wtth the Office of the Dlrector of Public Works. 5. That fire hydrants shall be installed and charged as required and determined to be necessary by the Chlef of the Fire Department prior to commencement of structural framing. 6. That subJect propercy shail be scrved by underground u[ilitles. 7. Tha[ drainage of subJec*_ property shall be disposed of in a manner satisfactory to the City Engineer. Ci. That reasonable landscaping, including irrigatton faciiities shall be installed fn [he medtan and the unpaved portion of the south side of Santa Ana Lanyon Road rtgh[-of-way In accordance with the requirements of the Superln[endent of Parkvray Maintenance. Foliowin~ lnstallation and acceptance, the City of Anaheim sliall assume the responsfbllity for main[enance of said landscaping in the median only with the owners of subject property maintaining the parkNay on the south side of Santa Ana Canyon Road. 9. That the owner(s) of subject property shall pay [he [rafffc signal assessment fee (Ordinance No. 33~6) in an amount as determined by [he City Council. for commercial buildings prior to [he issuance of a building permit. 10. BE IT FURTHER RESOLVED that ihc Anaheim City Ptanning Commission does hereby find and determine that adoption of this Resolutton is expressiy predtcated upon appllcant's compliance with each and all of the conditions heretnabove set forth. Should any such condition, or any part thereof~ be d~clared invaiid or u~enforceable by the final Judgment of any court of competent jurisdictton, then this Resolutto~. and any approvals herein contained, shall be deemed null and void.
