PC 80-1RESOLUTION NO. PC80 -1 A RESOLUTION OF THE ANAHEIM CITY PLANNING COMMISSION THAT PETITION FOR RECLASSIFICATION NO. 79 -80 -17 BE GRANTED. WHEREAS, the Anaheim City Planning Commission did receive a verified petition for Reclassification from the ANAHEIM REDEVELOPMENT AGENCY, 106 North Claudina Street, Suite 400, Anaheim, California 92805, owners, and NORMAN J, PRIEST,, EXECUTIVE DIRECTOR, ANAHEIM REDEVELOPMENT AGENCY, 106 North Claudina Street, Suite 400, Anaheim, California 92805, agent of certain real property situated in the City of Anaheim, County of Orange, State of California, described as follows: All that certain real property in the City of Anaheim, County of Orange, State of California being portions of Lots 22 through 33, inclusive, Block A of the Center Tract as per map recorded in Book 14, Page 13 of Miscellaneous Records of Los Angeles County, California together with those certain alleys in said Block A as vacated by Resolution No. 79 R -113, described as follows: Beginning at the intersection of the centerline of Anaheim Boulevard (formerly Los Angeles Street) (66.50 feet wide being 32.75 feet Northwesterly and 33.75 feet Southeasterly of said centerline) with the monumented survey line in Broadway (80.00 feet wide) as shown on a Map of Survey filed in Book 86, Page 46 of Record of Survey Maps, records of said Orange County; thence North 15° 32' 05" West along said centerline of Anaheim Boulevard, 239.98 feet; thence North 74° 26' 46" East, 77.25 feet to a point on a line parallel with and 77.25 feet Easterly of said centerline, said point being the True Point of Beginning of the land herein described; thence South 15 32' 05" East along said parallel line, 149.67 feet to the beginning of a curve concave Northeasterly and having a radius of 26.00 feet, said curve also being tangent to a line parallel with and 64.25 feet Northerly of said monumented survey line in Broadway; thence Southeasterly along said curve through a central angle of 90° 02' 55" an arc distance of 40.86 feet to said last mentioned parallel line; thence North 74° 25' 00" East, along said parallel line 245.74 feet to the beginning of a curve concave Northwesterly having a radius of 15.00 feet, said curve also being tangent to the Westerly line of Claudina Street, 60.00 feet wide; thence Northeasterly along said curve through a central angle of 89 52' 01" an arc distance of 23.53 feet to said Westerly line; thence North 15 27' 01" West, along said Westerly line, 160.58 feet to a line bearing North 74 26' 46" East from the True Point of Beginning; thence South 74° 26' 46" West along last said line, 286.99 feet to the True Point of Beginning. Containing an area of 1.152 acres more or less. WHEREAS, the City Planning Commission did schedule a public hearing at the City Hall in the City of Anaheim on December 17, 1979, at 1:30 p.m., notice of said public hearing having been duly given as required by law and in accordance with the provisions of the Anaheim Municipal Code, Chapter 18.03, to hear and consider evidence for and against said proposed reclassification and to investigate and make PC80 -1 findings and recommendations in connection therewith; said public hearing having been continued to the Planning Commission meeting of January 14, 1980; and WHEREAS, said Commission after due inspection, investigation and study made by itself and in its behalf, and after due consideration of all evidence and reports offered at said hearing, does find and determine the following facts: 1. That the petitioner proposes reclassification of subject property from the CG (Commercial, General) Zone to the CO (Commercial, Office and Professional) Zone. 2. That the Anaheim General Plan designates subject property for general commercial land uses. 3. That the proposed reclassification is hereby granted subject to the condition that prior to the introduction of an ordinance rezoning the property, the petitioner and City of Anaheim shall enter into a parking agreement to provide 130 parking spaces off -site in the existing City Hall parking structure located to the north of subject property, thereby providing the necessary parking spaces for the proposed office building. 4. That the proposed reclassification of subject property is necessary and /or desirable for the orderly and proper development of the community. 5. That the proposed reclassification of subject property does properly relate to the zones and their permitted uses locally established in close proximity to subject property and to the zones and their permitted uses generally established throughout the community. 6. That no one indicated their presence at said public hearing in opposition; and that no correspondence was received in opposition to the subject petition. ENVIRONMENTAL IMPACT FINDING: That the Anaheim City Planning Commission has reviewed the proposal to reclassify subject property from the CG (Commerical, General) Zone to the CO (Commercial, Office) Zone on a rectangularly- shaped parcel of land consisting of approximately 1.15 acres located at the northeast corner of Broadway and Anaheim Boulevard with frontages of approximately 287 feet on the north side of Broadway and 175 feet on the east side of Anaheim Boulevard; and does hereby approve the Negative Declaration from the requirement to prepare an environmental impact report on the basis that there would be no significant individual or cumulative adverse environmental impact due to the approval of this Negative Declaration since the Anaheim General Plan designates the subject property for geneal commercial land uses commensurate with the proposal; that no sensitive environmental impacts are involved in the proposal; that the Initial Study submitted by the petitioner indicates no significant individual or cumulative adverse environmental impacts; and that the Negative Declaration substantiating the foregoing findings is on file in the City of Anaheim Planning Department. NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planning Commission does hereby grant subject Petition for Reclassification and, by so doing, that Title 13- Zoning of the Anaheim Municipal Code be amended to exclude the above-described -2- PC80 -1 property from the CG (COMMERCIAL, GENERAL) ZONE and to incorporate said described property into the CO (COMMERCIAL, OFFICE AND PROFESSIOiNAL) ZONE upon the following conditions which are hereby found to be a necessary prerequisite to the proposed use of subject property in order to preserve the safety and general welfare of the Citizens of the City of Anaheim: 1. That the proposed office building shall comply with all signing requirements of the CO (Commercial, Office and Professional) Zone. 2. That the owner(s) of subject property shall submit, in writing, a request that Planning Commission terminate Conditional Use Permit Nos. 1480, 1542, 1692 and Special Use Request 59. 3. That prior to the introduction of an ordinance rezoning the property, the petitioner and the City of Anaheim shall enter into a parking agreement to provide 13 off -site parking spaces in the existing City Hall parking structure located to the north of subject property. 4. That trash storage areas shall be provided in accordance with approved plans on file with the Office of the Executive Director of Public Works. 5. That subject property shall be developed substantially in accordance with plans and specifications on file with the City of Anaheim marked Exhibit tlos. 1 through 7. 6. Prior to the introduction of an ordinance rezoning subject property, Condition Nos. 2 and 3, above - mentioned, shall be completed. The provisions or rights granted by this resolution shall become null and void by action of the Planning Commission unless said conditions are complied with within one year from the date hereof, or such further time as the Planning Commission may grant. 7. That Condition Nos. 1, 4 and 5, above - mentioned, shall be complied with prior to final building and zoning inspections. BE IT FURTHER RESOLVED that the Anaheim City Planning Commission does hereby find and determine that the adoption of this Resolution is expressly predicated upon applicant's compliance with each and all of the conditions hereinabove set forth. Should any condition or any part thereof, be declared invalid or unenforceable by the final judgment of any court of competent jurisdiction, then this Resolution, and any approvals herein contained, shall be deemed null and void.
