BItJGHA!1, Senlor Property ~lanagement Officer, Bank of America, 801 North Main Street, Santa Ana, California 927~1, agent, o` certain real property situated in the City of Anaheim, County of Orange, State of California, descrihed as: A portion of Lot 7, Block 5, of the Golden State Tract, shown as Parcel 4, of Parcel Maps, Book 50, page 1;, Official Records of Orange County, California. WHEREAS, the City Planning Commis:~ion did schedule a public hearing at the City Hall in the City of Anaheim on June 3~, 1980, at i:3~ p.m., notice of said public hearing having been duly given as required by lar~ and in accordance with the provisions of the Anaheim Municipal Code, Chapter 18,03, to hear and consider evidertce for and against said prnpnsed conditionsl use and to investigate and make findings and recommendations in connection therewith; sald public hparing having been continued to the Planning Commission meeting of July 11+, 1aR(t; and Wt1EREA5, said Cortmission after due inspection, investtaation and study made by itself and in its behalf, and after due cons!d~ration of all evidence and reports offered at said hearing~ does find and determine the following facts: 1. That the proposed use is hereby granted for a perlod of stx (6) months~ to exptre on January lh~ tg81~ on the basis that the petitioner ind(cated at the public hearing that it a~as his intention to purchase the property and remove the existing structure and develop the property ir. acccordance with ML site development standards. 3. That the requested ~•laiver is hereby granted on the basis that the petitioner ,tipulated to improve the existing landscaped setback~ including mainteiance of a sprinkler system~ and to maintain said landscaped setback; and on the basis that tl~e structure is existing ~-iit~i gasoline pump islands and canopies and ~`.he petitioner indicated he plans to purchase the property and im~rove it; thereby removing the islands and canopies wltliin six (6) nonths. ENVIP.ONMENTAL It1PACT FINDItJ;: That the Anaheim City Pl.anning Corrmission has reviewed the proposal to reta n an automobile detailin~ facility in th: ML (industrial~ Limited) Zone with rraiver of minimun l~ndscaned setback on a rectangularly-shaped parcel of land consisting of approximately 0.6 acre located at tfie nor[hr~est corner of ttiraloma Avenue and Y,raer~cr Boulevard, havinq a rrontage of approxinately 125 feet on the north side of Miraloma Avenue and a frort[age of approximately ~5J feet on the west sidc of Kraemer Boulevard; and does hereby approve the Negative Declaration from the requirement to prepare an environmental Tnpact report on the basis tfiat there ~aould he nu significan[ individuai or cumulative adverse environmental im~act Jue to the approval of this kegative Declar~tion since the Anaheim General Plan designates the subject property for general industrial land uses commensurate with [he proposal; that no sensitive enviro~mental impacts are involved in the proposal; that the Initial Study submitted b•; the peTitioner Irsc:Ic3tes r,c SIgt;Ific~nt fnuf:~!uu~l cr cu^::'~Li:~c a:!,,^•,c ~^•,}r^^~*~ntn1 1m~a~rs; an~± that the Negative Declaration substantiating the foregoing findings is on ffle in the City of Anaheim Planning Department. NOW, THEREFORE, BE IT RESOLVED that [he Anaheim City Planning Commission does hcreby grant subject Petition for Conditional Use Permlt, upon the following conditions ~•rhich are hereby found to be a necessary prerequtsite to the proposed use of the subject property in ordcr to preserve the safety and general welfare of the Citizens of the City of Anaheim: 1. That trash storage areas shall bP provided in accordance ~oith apnroved plans on file with the Office of the Executive Director of Puhlic uorks. 2. That the proposed auto detsiling faciltty shall camply 4:ith all siqniny requirements of the ML (Industrial~ Limited) Zone. 3. That the existing 5tructure shall bc brouq`~t up to the minimum standards of ttie Ci[y of Anaheim, includinc~ the Uniform Buildinq, Plumbinq. Electrical, Mechanical and Fire Codes as adop[ed by the City of Anaheim, -2- PC80-111 ~F. That all aut~mobile detailing and storaae shail he conflned to the interior of the building and/or that por*_ion of property enclosed by existing fencing. 5. That subject property shall be develooed substantially in accordanr.e with plans and sFecifications on file i-~ith ttie City of Anaheim mar~e~ Exhibit No. 1. 6. That Conaition No. 1 be comnleted 4~ithin 1i5 days of the date hereaf. 7. That Condition Nos. 2, 3 and 5, ahove-mentioned, shall be complied a~ith prior to final building and zoning inspections, 8.
