PC 80-184 A P.E50!U710N OF THE ANAHEIM CITY PLANNING COMMISSION THAT PETITION FOR VARIANCE N0. 3173 BE GRANTED WHEREAS, the Anaheim City Planning Commission did receive a verified Petition for Variance from C D H CORPORATION, A CALIFORNIA CORPORATION, 1016 West Katella Avenue, Anaheim, California 92802, owners of certain real property situated in the City of Anaheim, County of Orange, State of Cal~fornia described as: THE EAST 120 FEET OF THE NORTHWEST QUARTER OF THE NORTHWEST QUARTER OF THE NORTHWEST QUARTER OF SECTlON 27, 7'OWNSHIP 4 SOUTH, RANGE 10 WEST, IN THE RANCHO SAN JUAN CAJON DE SANTA ANA, AS SHOWN ON A MAP RECORDED IN BOOK 51, PAGE 10 OF MISCELLANEOUS MAPS, RECORDS OF ORANGE COUNTY, CALIFORNIA. EXCEPTING THEREFROM THE NORTHERLY 30 FEET. WHEREAS, the City Planning Commission did hold a public hearing at the Civic Center in the City of Anaheim on October 20, 1980, at 1:30 p.m., notice of said public hearing having been duly given as required by law and in accordance with the provisions of *_he Anaheim Municipal Code, Chapter 18.03, to hear and consider e~•idence for and against said proposed variancE and to investigate and make findings and recommendations in connection therewith; and WHEREAS, said Commission, after due inspection, investigation and study made by itself and in its behalf, and after due consideration of all evidence and reports offered at said hearing, does find and determine the following facts: l. That the petitioner proposes a waiver of the following to expand an existing moLel: SECTION 18.06.060.0243 - Minimum number of arking s aces. 133 required; g proposed 2. That the above-mentioned waiver is hereby granted on the basis that the petitioner demonstrated that a hardship exists in that the motel is located in the commercial-recreational area and, therefore, a large percentage of the guests arrive by transportation modes other than private automobile, thereby, reducing the need for parkiny spaces and that denial would deprive sub,ject property of a privilege being enjoyed by other properties and uses in the same zone and vicinity. 3• That there are exceptional or extraordinary circumstances or conditions aPPlicable to the property involved or to the intended use of the property that do not apply generally to the property or class of use in the same vicinity and zone. 4. That the requested ~iariance is necessary for the preservation and enjoyment of a substantial property right possessed by other property in the same vicinity and zone, and denied to the property in question. 5• That. the requested variance will not be materially detrimental to the public welfare or irijurious to the property or improvements in such vicinity and zone in which the property is located. 6. That no one indicated their presence at said public hearing in opposition; and that no correspondence was received in opposition to subject petition. ~C80-184 ENVIRONMENTAL IMPACT FINDING: That the Anaheim City Planning Commission has reviewed the prop~sal to expand an existing motel with waiver of minimum number of parkir.g spaces on a rectangularly-shaped parcel of land consisting of approximate;y 1.65 acres, having a frontage of approximately 120 feet on the south side of Katella Avenue, having a maximum depth of approximately 600 feet and being located approxirnately 530 feet east of the centerline of West Street;and does hereby ePprove the Negative Declaration from the requirement to prepare an environmental impact report on the basis that there would be no significant individual or cumulative adverse environmPntal impact due to the approval of this Negative Declaration since the Anaheim Generat Plan designates the subject property for medium-dens~ty residential land uses commensurate with the propo~al; that no sensitive environmental impacts are involved in the proposal; that the Initial Study submitted by the petitioner indicates no significant individual or cumulative adverse environmental impacts; and that the Negative Declaration substantiating the foregoing findings is on file in the City of Anaheim Planning Department. NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planning Commission does liereby grant subject Petition for Variance, upon the foliowing conditions which are hereby found to be a necessary prerequisite to the prnposed use of the subject property in order to preserve the safety a~d general welfare of the Citizens of the City of Anaheim: 1. That trash storage areas shall be provided in accordance with approved Plans on file with the Ofifice of the Executive Director of Public Works and that the property owner is responsible for placing the trash dumpsters at the street for scheduled trash collection. 2. That fire hydrants shall be installed and charged as required and determined to be necessary by the Chief of the Fire Department pr~or to commencement of structural framing. 3. That subject property sha11 be developed substantially in accordance with plans and specifications on file with the City of Anaheim marked Exhibit Nos. 1 through 3; and/or provided; however, that kitchen efficiency units may be installed ~n no uwre Chan 25% of the units, with a maximum of 6-cubic foot refrigerators; two- burner stoves, excluding oven and baking facilit'es; and single compartment sinks; except that the manager's unit will be allowed to have full kit~hen facilities. 4. That Condition Nos. 1 and 3~ above-mentioned, shall be complied with prior to final building and zoning inspections. BE fT FURTHER RESOLVED that the Anaheim City Planning Commission daes hereby find and determine that the adoption of this Resolution is exprassly predicated upon the applicant's compliance with each and all of the conditions hereinabove set forth. Should any condition or any part thereof, be declared invalid or unenforceable by the final judyement of any court of competent jurisdiction, then this Resolution and any approvals herein contained, shall be deemed null and void.
