YIHEREAS, the City Planning Commission did hold a puhlic hearing at the Civic Center i n the City of Anaheim on Novemher 3, 1980, at 1:30 p.m., notice of said public hearing having been duly given as required by larf and in accordance with the provisio ns of th~; Anaheim Municipai Code, Chapter 1£3,03, to hear and consider evidence fior and against said proposed reclassificatio~ ancl to investigate and make fi~.:ings and recommendations in c~nnectio~ ttierewith; and PCBo-18S .--, ..-. WHEREAS, said Commission, after due inspection, investigation and study made by itself and in its hehalf, and after due consideration of all evidence and reports offered at said hearing, does find and determine the folloi,iing facts: 1, That the petitioner proposes reclassification of subject ~roperty from the RS-A-43,000 (Residential/Agricultural) Zone to the P,!1-3~~0 (Residential, Multiple-Family) Zone, 2, That the Anaheim General Plan designates subject property for low- density residential land uses. 3. That the requested reclassification of subject property is hereby denied on the hasis that an increase in density ~-~ould create ac~ditional traffic and that the reclassification exceeds the density designation of the General Plan. 4. That the proposed reclassification of subject property is not necessary and/or desirable for the orderly and proper development of the community. 5. That the proposed reclassification of subject property does not properly relate to the zones and their permitted uses iocaliy established in close proximity to subject property and to the zones and their permitted uses generally established throughout the community. 6. That approximately 20 persons indicated their presence at said public hearing in opposition; and that a petition containing approxtmately 145 signatures was received in opposition to the subject petition, ENVIRONMENTAL IMPACT FINDINC: That the Anaheim City Planning Commission has reviei~aed the proposal to reclassify suhject property from the RS-A-43,000 (Residential/Agricultural) Zone to the RM-3~~0 (Residential, Muitiple-F'amily) Zone to permit a 1-lot, 60-unit condominium complex (48~ affordable) with waivers of minimum lot area per dwelling unit, maximum structural height, minimum recreational-leisure area and minimum number of parking spaces on ar irregularly-shaped parcel of land consisting of approximately 3.7 acres located north and east of the northeast corner of Simmons Avenue and Haster Street; having approximate frontaqes of 543 feet on the north side of Simmons Avenue and g$ feet on the east side of Haster Street, being located approximately 218 feet north of the centerline of Simmons Avenue and approximately 282 feet east of the centerline of Haster Street; and does hereby disapprove the Negative Declaration from the requirement to prepare an environmental impact report on the basis that there would be significant indlvidual or cumulative adverse environmental impact due to the approval of this Negative Declaretion since the Anaheim General Plan designates the suhject property for loar density land uses not commensurste with the proposal; that sensitive envtronmental impacts are involved in the proposal; and that the Initial Study submitted by the petittoner indicates significant individual or cumulative adverse environmental impacts. NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planning Commission does here5y deny subject Petition for Reclassification on the basis of the foregoing findings.
