That the proposed use and requested waiver are hereby denied on the basis that pursuant to Anaheim Munici;~al Code Section 1~3,a9.03p,~2p~ no conditional use permit shall be granted by the City of Anaheim for any adult ente~tatnment business if the premises upon whlch such business is located is within 1000 feet of a church or school site or within 50~ feet of a residentially zoned lot. The subject use is defined as an adult entertainment business by the Anahetm Nunicipal Code and the premises are located approximately 460 feet north of a church and school site and less than 33~ feet from residentfally zoned lots to the ~vest. 3. That the size and shape of the site proposed for the use is not adequate to allow the full development of the proposed use in a manner not detrimental to the particular area nor to the peace, health, safety, and generai welfare of the Citizens of the City of Anaheim, 5. That the granting of the Conditional Use Permit will be detrimental to the peace, health, safety and general welfare of the Citlzens of the City of Anaheim. 6. That the traffic generated by the proposed use will impose an undue burden upon the streets and highways designed and improved to carry the traffic in the area. 7. That one (1) person indicated their presence at said public heartng in opposition; and that no correspondence was received in opposition to the subject petttlon. ENUIRONMENTAL IMPACT FINDING: The Planning Director or his authorized representative has determined that the proposed project falls within the definition of Categorical Exemptions, Class 1, as defined in Paragraph 2 of the City of Anaheim Environmental Impact Report Guidelines and is, therefore~ categorically exempt from the requirement to prepare an EIR. NOW, THEREFGRE, BE tT RESOLVED that the Anaheim City Planning Commission does hereby deny subject Petition for Conditional Use Permtt on the basis of the aforementioned findings.
