WHEREAS, the Anaheim City Planning Canmission did receive a verified petition for Reclassification from AtJAHEIM REDEVELOPMENT AGE~ICY, 106 North Claudina Street~ Anaheim, Caltfornia 92805, owner of certaTn real property situated in the City of Anaheim, County of Orange~ State of California, described as fotloa~s: The site is Parcel 2 of a subdivision of portions of Blocks "A" and "B" of the center tract, as per map recorded in Book 14, Page 13 of Miscellaneous Records of Los Angeles County, California, and a portion of the resubdivision of the northerly part of 81ock A of the center tract, as per map recorded in Bool: e, Page 22 of Mlscellaneous Maps, Records of Orange County, together o-~ith a portion of Claudina Street, vacated by Resolution Plo. 76R-653, of the City Council of the City of Anaheim, Recorded December 1, tg76 in Book it979, Page 1467 of Official Records, of said Orange County and portions of the alleys as shown on said maps, vacated by Resolutlon No. 80R-244 Book 13042 Page 103 of Official Records of said Orange County. WHEREAS, the Clty Planning Commission did hold a public hearing at the Civic Center in the Ctty of Anaheim on November 17, 1980, at 7:00 p.m., notice of said public hearT~g having been duly given as required by law and in accordance with the provisions of the Anaheim Municipal Code, Chapter 1~',03, to hear and constder evidence for and agalnst said prop~sed reclassification and to investtgate and make findings and recommendations in connection therewlth; and WHEREAS, said Commission, after due inspection, investigatton and study made by ItselP and in i[s behatf, and after due consideration of alt evidence artd reports affered at said hearing, does find and determine the foltowtng facts: 1. That the petitioner proposes reclassificatlon of sub.ject property from the RM-1200 (Residential, Ptuitiple-Family) Zone to the CL (Commercial, Limited) Znne. 2, That the Anaheim General Plan designates subj~ct property for general commercial land uses. 3. That the proposed reclassiftcation of subject property is necessary and/or desirable for the orderly and proper develop~ent of the conmunity. 4, That the proposed rectassification of subject property does properiy relate to the zones and their permitted uses locally estahlished in close proximity to subject property and to the zones and their permitted u•es ge~erally established throughout th~ community. 5. That the proposed reclassification of subject property requires the improvement of a6utting streets in accordance with the Ciru~lation Element of the General Plan, due to the anticipated increase in traffic which will be generated by the intensification of land use. PC8o-2o6 ~._--- 6. That no one indicated their presence at: sald public hearing in opposition; and that no corresponder.ce was received in opposition to the subJect petition. ENViROPlMENTAL IMPACT FINDIPlG: That the Anaheim City Planning Commisston has revie~~ed the proposal to reclass y subject pro~erty from the RM-12~Q (Residential~ Multiple-Family) Zone to the CL (Cortmercial, Limited) Zone~ on a rectangularly-shaped parcel of land consisting of approximately 1.3 acres iocated at the northwest corner of Broada~ay and Philadelphia Street, having approximate frontages of 330 feet on the north side of Broadway and 175 feet on the ~aest side of Philadelphia Street; and does hereby approve the Negative Declaratian from the requirement to prepare an environmental impact report on the basis that there would be no significant individua) or cumulative adverse environmental impact due to the approval of this Negative Declaration since the Anaheim General Plan designates the subject property for general commercial land uses commensurate with the proposal; that no sensitive environmental tmpacts are involved in the proposal; that the Initial Study submitted by the petitioner indicates no si9nificant individual or cumulat(ve adverse environmental impacts; and that the Negative Declaration substantiating the foregoing findings is on file in the City of Anaheim Planning Department. NOW~ THEREFORE, BE IT RESOLVED that the Anaheim City Planning Commisslon does hereby grant subject Petition for Reclassification and, by so doing, that Title 18-Zoning of the Anaheim Municipal Code be amended to exclude the above-described property from the RM-1200 (RESIDENTIAL, MULTIPLE-FAMILY) ZONE and to incorporate said described property into the CL (COMMERCIAL, LIMITED) ZONE upon the following conditions which are hereby found to be a necessary prerequisite to the proposed use of subject property in order to preserve the safety and general welfare of the Citizens of the City of Anaheim: 1. That trash storage areas shall be orovided in accordance with approved plans on file ~atth the Office of the Executive Director of Public Works. Z. That sidev~aiks shali be instalied alang Claudina Street as requIred by the City Engineer and in accordance with standard plans and speciftcations on fiie in the office of the City Engineer. 3. That Condition Nos. 1 and 2, above-mentioned, shall be complied with prior to final building and zoning inspections. BE IT FURTHER RESOLVED that the Anaheim City Planning Commission does hereby find and determine that the adoption of this Resolution is expressly predicated upon applicant's compliance with each and all of the conditions hereinabove set forth. Should any condition or any part thereof, be declared invalid or unenforceabla by the final judgment of any court of competent jurisdiction, then this Resolution, and any approvals hereln contained~ shall be deemed null and void.
