WHEREAS, the City Planning Commission d~d hold a public heartng at the Civtc pub)ec 'hearingitha~i~Anaheim on December 1, lqgp, at 1:30 p.m.~ nottce of said g been duly given as requtred by law and in accordance with the provisions of the Anaheim Municipal Code, Chapter 18.Q3, ta ~iear and consider evidence for and against said proposed conditional use permit and ~o investigate and make fPndings and recortxnendations in connection therewith; and WHEREAS, said Commission, after due inspection, investigation and study made by itself and in its beha)f, and after due consideration of all evtdence and reports offered at said hearing, does find and determine the following facts: 1, That the proposed use is properly one for which a conditional use Permit is authorized by qnaheim tlunicipal Code Sectior. i8,48,050.180 to permit the construction of recreational facilities in conjunction with an existing educational ~nstitution. 3, That the proposed use will not adversely affect the adjoining land uses ~nd the graath and development of the area in which it is proposed to be located. 4, That the size and shape of the site proposed for the use ts adequate to a)low the full development of the proposed use in a manner not detrtmental to the Particular area nor to the peace, health, safety, and general welfare of the Ci[izens of the Clty of Anaheim, ~ -2- PCt30-218 ,~ ~.. 5, That the granting of the Conditional Use Permlt under tf:e conditions imposed, if any, will not be detrimental to the peace~ health, safety and general welfare of the Citizens of the City of Anaheim, 6. That the traffic generated by the proposed use will not imoose an undue burden upon the streets and highways designed and improved to carry the Lraffic in the area. 7, That no one indicated their presence at said public hearing in opposltion; and that no correspondence ~•~as receiv~d in opposition to tfie subject petition. ENVIRONMENTAL tMPACT FINDING: That the Anaheim City Plannine Commission has reviewed the proposa to permit t e construction of recreational faciltties in conjunction with an existing educational institution on an irregularly-shaped parcel of land consisting of approximately 5.85 acres~ having a frontage of approximately 336 feet on the north side of Katella Avenue, having a maximum aepth of approximately 615 feet and being located appro:cimately 830 feet east of the centerltne of Harbor Boulevard; and does hereby approve the Negative Declaration from the requirei~ent to prepare an environmental impact report on the basis that there would be no significant individual o~ cumulative adverse environmental impact due to the approval of this Negative Declarat~on since the Anaheim General Plan designates the subject property for commerclal recreation land uses commensurate with the proposai; that no sensitive environmental impacts are involved in the proposal; that the Initial Study submitted by the petitioner indicates no significar.t lndividual or cumulative adverse environmentai tmpacts; and that the Negative Declaration substantiating the foregoing fiindings is on file in the City of Anaheim Planning Department. NOW, THEREFORE, BE IT RESOLVED that the Anahetm City Planning Commtssion does hereby grant subject Petition for Conditional Use Permit, upon the following conditions which are hereby found to be a necessary prerequisite to the proposed use of the subject property in order to preserve the safety and general welfare of the Cttizens oF the City of Anaheim: 1. That all engineering requirements of the City of Anaheim along Katella Avenue including preparation of improvement plans and Tnstallatio~ of all improvements such as curbs and gutters, sTdewalks, street grading and paving, drainage facilfties or other appurtenant work~ shali be complied with as required by the City Engineer and in accordance with specifications on file in the Office of the City Engineer; that street lighting facilities along Katella Avenue shall be installed as requtred by the Office of Uttlities General Manager~ and in accordance with specifications on file in the OffTce of Utilities General Manaqer; and/or that a bond, certtficate of deposit, letter of credit, or cash, in an amount and form satisfactory to the City of Anaheim shall be posted r~ith the City to guarantee the instailation of the above-mentioned requirements prfor to occupancy. 2. That trash storage areas shall be provtded in accordance with approved plans on file with the Office oF the Executive Director of Public Wor4:s. 3. That the proposed gymnasium facility shail be constructed in accordance with applicable building and fire Codes as may be required by the Chief Building ~nspector and Fire Marshall, 5, That this Conditional Use Permit is granted subject to the completion Qf Reclassification No. 66-67-61, noa~ pending. 6. That subject property shall be developed substantially in accordance With plans and specifications on file with the City of Anaheim marked Exhibit Nos. 1 through 4. 7. That Condition Nos. 2 and 6, above-mentioned, shall be complied with P~tor to final building and zoning inspections, BE IT FURTHER RESOLVED that the Anaheim Ctty Planning Commisston does hereby flnd and determtne that adoption of this Resolution is expressly predicated upon aPpltcant's compliance with each and all of the condittons hereinabove set forth. should any such condition, or any part thereof~ be declared invalid or unenforceable by the final judgment of any court of competent jurisdiction, then this Resolutian, and any approvals herein contained, shall be deemed nul) and void.
