WHEREAS, the Anaheim City Planning Commission did receive a verified petition for Reclasstfication from MARY S. NELSON, ADMIPlISTRATOR FOR IDA M. RANPlOW ESTATE, c/o Weinfeld b Mixono Attorneys at L~w, 601 North Parkcenter Drive, Suite 203, Santa Ana, California 927~1, owner and LINDBORG-DAHL IPIVESTORS, 1720 Pacific Coast Highway, Huntington Beach, California 92648, agent of certain real property situated in the C1ty of Anaheim, County of Orange, State of California, described as foliows; That portion of the NorLheast quarter of the Southeast quarter of sectlon 20~ Township 4 Sou~rh~ Range 10 West, in the Rancho Las Bolsas as shown on a map recorded in Book 51, Page 10 of Miscel)aneous Maps, records of Orange County, California, described as follows: Beginning at the northeast corner of t~z Southeast quarter of said Section 20; thence West along the North line of said Northeast quarter 1323.85 feet to the Northwest corner of satd Northeast quarter thence South along the West line of said Northeast quarter to the Northwest corner of the land conveyed to A, B. WhIEREAS, the Ctty Planniny Commission did huld a public hearing at the Civic Center in the City of Anaheim on December 1, 1980, at 1:30 p.m., nottce of said F'~b1ic hearing havina been duly given as required by law and in accordance with the provtsions of the Anahetm Municipai Code. Chapter 18.03, tc hear and consider evidence for and against said proposed reclassification and to investtgate and make findings and recommendations tn connection therearith; said public hearing having been continued to the Planning Commissfon meeting of December 15, 1980; and PCt30-'l28 WHEREAS, said Commission, after due inspection, investigation and study made bY itseif and in its behalf, and after due consideration of all evidence and reports offered at said hearing, does find and determine the folloo~tng facts: 1. That the peti*_ioner proposes reclassification of subject property from the RS-A-43~000 (Residential/Agricultural) Zone to the RM-3~00 (Residenttal, Multiple-Family) Zone. 2. That the Anaheim General Plan designates subject property for low- medium density residential land uses. 3. That the proposed reclassification of subject property ts necessary a~d/or desirable for the orderly and proper development of the community. 4. That the proposed reclassification of subject property does properly relate to the zones and their permitted uses locally established in close proximtty to subject property and to the zones and their permitted uses generally establtshed throughout the community. 5. That the proposed reclassification of subject property requires the dedicatlon and improvement of abutting streets in accordance with the Ctrculation Element of the General Plan, due to the anticipated increase in traffic which will be 9enerated by the intensification of land use. 6. That 3 Persons indicated their presence at said public hearing in oPposition; and that no correspondence was received in opposittnn to the subject Petition. ENVIRONMENTAL IMPACT FINDING: That the Anaheim City Planning Commission has reviewed the proposal to reclassify suhject property from the RS-A-43,000 ~Residential/Agricultural) Zone to the RM-3000 (Residential, Multiple-Family) Zone to establish a 5-lot, 22U'unit condominium subdlvision (25$ affordable) with waivers of minimum tot area per dweiltng unit, maximum structural height, minimum f)oor area, and minimum number of pari<ing spaces on an irregularly-shaped parcel of land consisting of approximately 12.3 acres located at the southwest carner of Cerritos Avenue and Euclid Street, having approximate frontages of 90 feet on the south side of Cerrttos Avenue and 425 feet on tne west stde of Eucltd Street; and does hereby aPProved the Negative ~eclaration from Lhe requirement to prepare an environmental impact report on the basis that tfiere would be no significant individual or cumulattve adverse environmental impact due to the approval of thts Negative Dectaration since the Anaheim General Plan designates the subJect property for low medium density land uses commensurate with the proposal; that no sensitive environmental impacts are involved in the proposal; that the Initial Study submitted bY the petitioner indicates no signiftcant individual or c~mulative adverse environmental impac:s; and that the Negative Declaration substantiating the foreyoing findings ts on file tn the City of Anaheim Planning Department. NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planning Commission does hereby grant subject Petitlon for Reclassification and, by so doing, that Title 18-Zoning of the Anaheim Munlcipai Code be amended to exclude the above-described Property from the RS-A-43,000 (RE~IDENTIAL/AGRICULTURAL) ZONE and to lncorporate satd described property into the RM-3000 (RESIDENTIAL, PIULTIPLF-FAMILY) 20NE upon the following conditior,s which are hereby found to be a necessary prerequisite to the proposed use of subject property tn order to preserve the safety and general welfare of the Citizens of the City of Anah~tm: -2- FC80-228 1, That all engineerinq requirements of the City of Anaheim along Cerritos Avenue and Euclid Street including preparation of improvement ptans and installatlon of all improvements such as curhs and gutters, sidev~alks~ street grading and paving, drainage facilities or other appurtenant ~•~ork, shall he complied o-~ith as required by the City Engineer and in accordance with specifications on file in the Cffir,e of the City Engineer; that street lighting facilities along Cerritos Avenue and Eucltd Street shall be installed as required by the Offtce of Utili*_~es General tlanager~ and In accordance with spaciflcations on file in the Off!ce of Utiltties General Manager; and/or that a bond, certificate of depocit; ietter of credit, or cash, in an amount and form satisfactory to the City of Araneim shall be posted with the City to guarantee the lnstallation of the above-mentioned requirements prior to occupancy. 2. That the oa:ner(s) of suhject propertY shall pay to the City of Anaheim a fee, in an amount as determined by the City Council, for tree ~lanting purposes along Cerritos Avenue and Euclid Street. 3, That trash storage areas shall be provided tn accordance 1•~ith approved plans on file with the Office of the Executtve Director of Public Works. 4. That fire hydrants shall be installed and charqed as required and determined to be necessary by the Chief of the Fire Department prlor to commencement of structurat framing. 5. That subject property shall be served by underground utilittes. 6. That drainage of subject praoerty sfiall be disposed of in a manner satisfactory to the City Engineer. (A starm drain lateral shatl be constructed Tn Cerrttos Avenue so that ultimately all dralnaae frrn subJect property will be taken back to the proposed draln in Euclid Avenue.) 7. That the o~•m er of subject property shaii pay to the City of Artaheim :he park and recreation in-lieu fees as determined to be approprtate by the City Council, said fees to be paid at the time the building permit is issued. 8. That the original documents of rhe covenants~ condttions, and restricttons, and a letter addressed to developer's tftle corpany authorizing recordatlon thereof, shall be submitted to the Ctty Attorney's office and approved by the City Attorney~s Office, Public Utilities Dept., Buildine Division, and the Engineering DivTsion prior to final tract map approval. Said documents, as approved, shall be filed and recorded in the Office of the Orange County Recorder. g, That street names shall be aporoved by the City Planring Department prior to approval of a final tract map. 1Q. That all private streets shall he developed in accordance with the City of Anaheim's Standard Detail No, 122 for prlvate streets, including installation of stre~t name signs. That an ordinance rezoning the subject pronerty shall in no event become effective except upon or follo~.~ing the recordation af Final 7ract Map No. 11053 within the time specified ln Government Code Secrion (F4~3.S or such further time as the advisory agency or C1ty Council may grant. 14, That the oo-mer(s) of subject property shall pay the traffic signal assessment fee (Ordtnance No. 389E) in an amount as determfned by the C~ty Council, for eacF new dwelling unit prior to the issuance of a butlding permit. 14. That all on-slte sanitary sewers shall be private. 15. That appropriate water assessm~nt fees as determined by the Office of the Utilities General Manager shall be paid to the C1ty o.' Anaheim priar to the issuance of a l~uitding permit. i6. That subJect property shall be develope~ suhstantially in accordance with plans and specTficatTons on file ~iith the City of Anaheim marked Exhibit Nos. 1 through 6. 17, Prlor to the introduction of an ordtnance re~oning sub;ect property, Condition Plos. 2, 8 and 12, ahove-mentioned, shall he completed. The provisians cr rights granted by this resolution shall hecome null and void by actton of the Planntng Commissio~ unless said canditions are complied wtth withtn one year from the date hereof, or such further time as the Planning Commtssion may grant. 1R. Should any such condition, or any part thereof, be declared ir,valid or unenforceable by the final judgment of any court of competent Jurisdiction, then thfs Resolution, and any approvals herein contained, shall be deemed null and void.
