That the proposed use is properly one for alhich a conditional use permit is authorize~ oy ~,nalieim ~iunicipal Code SecCian 1'.G1.G~O.D%~~ tu wit: To permit an automotive and truck repair shop in the ~iL (Industrial, Limited) Zone. 2. That the proposed use is hereby granted subject to th~ petitioner~s stiputations that there shall be no outdoor storage other than parking of tractors or trucks, and that all work shall be conducted a~holly inside the structure and no trailers shall be brought to the facility. 3. That the proposed use is hereby grantecf for a period of one (1) year, subject to review for possible extensions of time. iE. That the proposed use :•~ill not adversely affect tlie adjotning land uses and the 9ro~ath and development of the area in wliich ~t is proposecl to be located. 5. That the size and shape of the site pro~osed for the use is adequate to allow the full devclopment of the proposed use in a manner not detrimental to the particular area nor to the peace, health, safPty, and general ~•~elfare of the Citizens of the City of rlnaheim. That 2 persons indicated their presence at said publtc hearing in opposition; and that no correspondence ~vas receive~l in opposition to the subject petition. EPJVIROhJM[tlT~l IFIPACT FItJDIP1G: That the Anaheim City Planning Commission has reviewed the proposal to perm(t an automobile anri trucl: repair shop in the F1L (Industrial, Limited) zone on an irregularly-shaped parcel of land consisting of approximately ~.f acre located at the sc~itheast corner of Miraloma Avenue and Sunshine 41ay, having approximate frontages of 1?3 feet on the southeast side of 1•liraloma Avenue and ~!G2 feet on the east and north~•:est sidPS of Sunshine 4lay; and does hereby approve the Plegative Declaration from the requirement to prepare an environme~ital inpact report on the basis that there ~•~ould be no significant individual or cumulatlve adverse environmental impact due to the approval of this P~egative Declaration since the Anaheim GenAral Plan designates the subject property for general industrial land uses commens~rate 4~ith the pr~oosal; that no sensittve environmental impacts are involved in the proposal; that the Initial Study submitted by the peCitioner indicates no significant individual or cunulative adverse environmental impacts; and that the Negative Declaration substantiating the foreooing findings is on file in the City of Anaheim Planning Department. PlOb/, T~iERCFORE, BE IT RES(1LV[D that the Anaheim City Planr.ing Comr~ission does hereby grant subject Petition for Conditional Use Permit, u~on the `o]lo~~ing conditions :~~hich are hereby found to he a necessary prerequisite to the propose~i use of the subject property ln order to preserve the safety and general 4relfare of the Citizens of the City of Anaheim: i. That trash storage areas shall be provided in accordance 4~ith approved plans on file ~•~ith the Office of tf~e Executive Director of Puhlic llorks. 2. That the proposed automotive and truck repair shall comply with all signing requirements of the P1L (Industrial, Limited) zoninu. 3. That all repair i•~or6: on vehi:les shall be conducted entirely within the building and there sha11 be no outdoor storage of vehicles except for parking of tractors and trucks. 4. That subject property shall be develooed substantially in accordance with plans and specifications on file ti•~ith the City of Anahein mar!~ed Exhibit ?los. 1 through 3• 5. 7hat the o~•mer(s) of subject property shall submit a let:er requesting the termination of Conditional llse Permit Plo. 18~7 to the Pl~nninc~ ~epart~nent. 6. That Condition tlo. 5, abave mentioned, shall be complied with prior to the commencement of the activity authorized under this resolution, or prior to the -2- PC90-71 time that the building perr~iit is issuerl, or ~~ritliin a period of one year from date hereof, ~•~hichever occurs first, or such further time as th,e Planning Commission may grant. 7. That this use is approved for a period of one (1) year at which time an extension of time may be granted follo~ring a a~ritten request and the determination by the Planning Conmissiort that the usc has not had an adverse impact on surrounding land uses and businesses. BE IT FURTHER RESOLVED that the flnaheim City Planning Commission does hereby find and determine that adoption of this Resolution is expressly predicated upon appl;cant's complia-ce ~•~ith each and all of the conditions hereinahove set f•~rth. Should any such condition, or any part thereof, he declared invalid or unenforceable by the final judgment of any court of compete~t jurisdiction, then this Resolution, and any approvals herein contained, shall be deemed null and void.
