PC8(1-35 A RESOLUTIOtJ OF ThIE AIJAHEItt CITY PLP,r~riir~c COHMISSIOW THAT PETITIOPI FOR COPIDITIOflAL USE PERMIT M0. 2~81 BE GRAMTED WHEREAS, the Anaheim City Planning Commission did receive a verified Petition for Conditional Use Permit from NDJ ASSOCIAT[S, 2426 22nd Street, Ne~aport Beach, California, g2Fi07, owner, and HARVEY lJ. 4lOLFE, 11~i1 North Cosby Way, Suite "E", Anaheim, California 92306, agent, of certain real property situated in the City of Anaheim, County of Orange, State of Ca~ifornia, described as: PARCEL 3, IF! THE CITY OF ANANEIM, COUPITY OF ORANGE, STATE OF CALIFORNIA, RS SHOWN ON A MAP FILED IM BOOY. 4~ PAr,ES 5 AIdD 6 OF PARCEL MAPS, IN THE OFFICE OF THE COUFJTY RECOP,DER OF SAID COUNTY. blHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City of Anaheim on tlay 19, 19g0, at 1:3~ p.m., notice of said public hearin9 having been duly given as required by lav~ and in accordance with the provistons of the AnaAeim Muntcipal Code, Chapter 1R.~3, to hear and consider evidence for and against said proposed conditional use permit and to investigate and make findings and recommendations in connection therewith; and WHEREAS, said Commission, after due inspection, investigation and study made by itself and in its behalf, and after due consideration of a11 evidence and reports offered at said hearing, does find and determine the followind facts: 1. That the proposed use is properly one for which a conditional use permit is auth~rPzed hy Anaheim "1unlctpal Code Section 1°.!1,^Sf:.C'1R,G0; Lo wit: to retain an existing exterminating service. 2. That the proposed use ~ri11 not adversely affect the acljointng land uses and the growth 3nd development of the area in ~~rhich it is proposed to be located. 3. Ti~at the size and shape of the site proposed for the use is adequate to allow the full deve~opment of the proposed use in a manner not detrimental to the particular area nor to the peace~ health, safety, and general welfare of the Citizens of the Ctty of Anahe?m. 4. That ths granting of the Conditional Use Permit under the conditions imposed, if any, will not be detrimental to the peace, health, safety and general a~elfare of the Citizens of the City of Anaheim. 5. That the traffic generated by the proposed use wfll not impose an undue burden upon the streets and highv~ays designed and improved to carry the traffic in the area. PCdo-85 ~. That no one indicated their presence at said public hearing in opposition; and that no correspondence ~•+as received in opposition to the subject petition. EtJVIRO~lMENTAL 111PACT FIDlDIWG: That thn Anaheim City Plannino Commission has reviewed the proposal to retain an existing exterminating service on a rectangularly- shaped parcel of land consisting of approximately 2.1! acres, having a frontage of approximately 312 feet on the ~•~est side of Cosby blay, having a maximum depth of approximately 3f~~~ feet and being located approximately 2~3 feet north of the cen*_erline of La Palma Avenue; and does herehy approve ttie tlegative Declaration from the requirement t~~ prepare an environmental im~act report on the basis that there would be no significant individual or cumulative adverse environmental impact due to the approval of this Plegative Declaration since the AnaheiM General Plan designates the subject property for generalindustrial land uses commensurate ~~ith the proposal; that no sensitive environmental impacts are involved in the proposal; that the Initial Study submitted by the petitioner indicates no siqnificant individuat or cumulat+ve adverse environmental impacts; and that the Plegative Declaration substantiating the foregoing findings is on file in t!~e City of Anaheim Planning Department. NOW, THEREFORE, BE IT R.FCOL~ED that the Anaheim City Planntn~ Commission does hereby grant subject Petition for Conditional Use Permit, upon the following conditions ~ahich are hereby found to be a necessary prerequisite *_o the proposed use of the subject property in order to preserve the safety and 9eneral welfare of the Citizens of the City of Anaheim: 1. That subject property shall be develo~~ed substantially in accordance with plans and speci~ications on file ti-+ith the City of Anaheim marked Exhibit PJos. 1 and 2. SE !T F!fRTNER RESOL~IED that the Anahe+m City Plannin~ Commission does hereby find and determine that adoption of this Resolution is expressly predicated upon applica~t's compliance with each and all of the conditions hereinabove set forth.
