71R-081 RESOLUTION NO. 71R-8l A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM GRANTING VARIANCE NO. 2228, IN PART. WHEREAS, after a request for variance by Ben W. Sandknop, et al., c/o J. Grayson, owner; Del Brown, agent, was received, a public hearing before the Planning Commission of the City of Anaheim was held upon due and proper notice as a result of which Variance No. 2228 was granted in part, covering the following described property: The west 150.00 feet of the east 898.00 feet of the north half of the northeast quarter of the northeast quarter of Section 13, Township 4 South, Range 11 West, in the Rancho Los Coyotes, City of Anaheim, County of Orange, State of California, as per map recorded in Book 51 page 11 of Miscellaneous Maps, in the office of the County Recorder of said County. Except that portion thereof lying northerly of the southerly line of the 70.00 foot strip of land described in the final order of condemnation filed in connection with Case No. 73187 in the Superior Court of the state of California, in and for the County of Orange, a copy of said final order was recorded September 12, 1958 in Book 4414 page 337 of Official Records. WHEREAS, thereafter, within the time prescribed by law an interested party or the City Council on its own motion caused the review of said Planning Commission action at a public hearing noticed and held as prescribed by law and as a result thereof the City Council does hereby make the following findings: 1. That there are special circumstances applicable to the property, including size, shape, topography, location or surroundings, which do not apply to other property under identical zoning classification in the vicinity. 2. That, because of special circumstances shown in (1) above, strict application of the zoning code deprives the property of privileges enjoyed by other property under identical zoning classification in the vicinity. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that a conditional zoning variance be, and the same is hereby granted, in part, permitting the establishment of an l8.-unit apartment complex on the property hereinbefore described with waivers of the following sections of the Anaheim Municipal Code: SECTION 18.28.0S0(6-a-4) Minimum required landscaped setback (15 feet required; 7 feet, 6 inches proposed). SECTION l8.28.050(6-a-S) Code requirement that access to carports be from the alley only. (Access directly to Stinson Street is proposed). That said variance be granted, in part, subject to the following conditions: 1. That this variance is granted subject to the completion of Reclassification No. 70-71-24, now pending. 2. That subject property shall be developed substantially in accordance with plans and specifications on file with the City of Anaheim, marked Exhibit Nos. 1, 2, 3, 4 and 5, provided, however, that a 6-foot masonry wall shall be constructed along the east property line, and on the R-l property south of the existing alley, and that a 12-foot wide gate shall be provided within said wall to provide the R-l property owner ingress and egress to the alley which he presently enjoys, as stipulated to by the petitioner, and in accordance with permission given by the single-family home owner for said con- struction. BE IT FURTHER RESOLVED that the City Council hereby reserves the right to revoke such variance permit for good cause or failure of said owner, his heirs, successors or assigns to comply with the Anaheim Municipal Code and regulations and the conditions herein. Said variance is granted for the term pre- scribed by the Anaheim Municipal Code unless otherwise specified herein. THE FOREGOING RESOLUTION is approved and signed by me this 2nd day of March, 1971.
