71R-079 RESOLUTION NO. 71R-79 A RE.BOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM GRANTING CONDITIONAL USE PERMIT NO. 1157. WHEREAS, the City Planning Commission of the City of Anaheim did receive an application for a conditional use pe~it fram Dr. Irving Moskowitz, owner; Jerry Hansen, Century Conva- lescent Center, .Inc., agent, to establish a 99-bed one-story general hospital (in conjunction with a 240-bed convalescent hospital) on the following described property in the City of Anaheim, County of Orange, State of California, to wit: PARCEL 1: That portion of Lot 26 of Anaheim Extension, in the City of Anaheim, County of Orange, State of Cali"fornia, as shown on a map of survey made by William Hamel, a copy of which is filed in the office of the County Recorder of said Orange County, in book 3 page 163 et seq., entitled "Los Angeles County Maps," described as follows: Beginning at a point on the easterly line of said Lot 26, northerly 503.19 feet from the southeast corner of said lot, said southeast corner being for the purpose of this description at the intersection of the center line of Ball" "Road with the center line of Los Angeles Street; thence northerly 84 feet along said easterly line; thence westerly to a point on the westerly line of said lot being on the center line of Lemon Street, northerly 415.89 feet thereon from the southerly line of said lot; thence southerly 84 feet along said westerly line to a point which is northerly 331..89 feet thereon from the southerly line of said loti thence easterly 612.49 feet to the point of beginning. EXCEPT all oil, gas and other hydrocarbon substances and minerals in and under said land below 500 feet from the surface thereof, but without the right to enter upon any part of said land for the purpose of recovering said sub- stances, as reserved by DOBsn I. Wagner, a widow, in deed dated April 1, 1960 and recorded May 4, 1960 in book 5226 page 211 of Official Records. Nilsson, agent, for a renearing,u~on further consideration of the matter, the City council did direct tne City Clerk to set said request for a conditional use pennit to establish a 99-bed, one- story general hospital on subjec.t propert~{ for rehearing before tne City Council; and vmEP~AS, said request for said conditional use permit was set for ~')uJ::;lic rel1earing on ~"~arch 2, 1971, at the Cit:! Hall, in the City of Anaheim, and notices of said public hearing were duly given as rcg:uir.2;G by la~1 and the provisions of the Anaheim Eunicipa1 Code~ and ~rrIEREAS, tne City Council finds, after careful considera- tion of all evidence and reports offered at said hearing, that: 1. The proposed use is properly one for which a conditional use permit is authorized by the Anaheim ~.1uniciJ;~al Code. 2. The proDoseu use will not adversely affect the adjolniii.g land uses and tile gro,\-"th- and development of the area in \-lhici1 it is t;)roposed to be located. 3. The traffic generated by the proposed use will not impose an undue burden upon the streets and highways designed and improved to carry the traffic in. the area. 5. The granting of the conditional use permit under the conditions imposed will not be detrimental to the peace, health, safety and general welfare of the citizens of the City of Anaheim. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anahe~ that the action of the City Planning Commission granting said conditional use pe~it be and the same is hereby approved, and that Conditional Use Pe~it No. 1157 be, and the same is hereby, granted permitting the establishment of a 99-bed one-story general hospital, on the property hereinbefore described, subject to the following conditions: 1. That this conditional use pe~it is granted subject to the completion of conditions of Conditional Use Permit No. 1137. 2. That subject property shall be developed substantially in accordance with plans and specifications on file with the City of Anaheim marked Exhibit Nos. 1, 2, 3 and 4. 3. That an organization, satisfactory to the. City Council for the operation and use of the hospital be established prior to commencement of construction and prior to the issuance of a building permit. The City Council hereby reserves the right to revoke such Conditional Use Pe~it for good cause or failure of said owner, his heirs, successors or assigns to comply with .the Anaheim Municipal Code and regulations and the conditions herein.
