offered at said hearing, does find anu dete••mine the follcn•~ing facts:
1. That the proposed use is properiy one ror i-~hic'~ a conditional use
permit is authorized by Anaheim Municipal Code Section 18.?t.n5o.n9n t~ wit: to
permit expansion of an er.isting board and care facility for :~ maximum of `ifteen (15j
persons.
2. That the proposed use is hereby granted suhject to the petitioner's
stipulation at t'ie puLlic hearing :hat the television set or other noise producing
devices used outdoors on the patio shall he turned off no later than ~o:3n p.m.
3. That the proposed use ~~ili not adversely affect the ~djoining land uses
and the growth and devetopment ef the area in i•~hich it is ~roposed to he located.
4. That the siz~ and shaoe of the site ~ro~osed for the use is adequate to
allor~ the full development of the proposed use in a manner n~t detrimental to the
par*.icular area nor to the peace, health, safety, and ~eneral o-~elfare of the Citizens
of the City of Anaheim,
5. That the 9ranting of the Conditional ~~se Perriit under the conditions

opposltion; and that n~ correspondence was receive~l in opposition to the subject
petition.

revieo-~ed the proposal to permit expansion of an existin~ board and care facility on
havingcaafronta,e ofaaed parcel ofr land consisting oi approxtmately 0.34 acre, and
9 pproximately 1~7 feet on the south side of Orangeo-~ood Avenue
(351+ East Orangewood Avenue); a~d does hereby approve the ~legative Declaration from
the requirement to prepare an environmental impact report on the f>asls that there
would be no significant individual ar cumulative adverse environmental impact due to
the approval of this Megative Declar•ation since the Analieim f,eneral P)an designates
the subject property for loti,~-medium density land uses commensurate ~•iith the praposal;
that no sensitive environmental impacts are invoived in the proposal; that the
Initial Study submitted by the petitioner inJicates no slqnificant individual or
cumulative adverse environmental impacts; and that the Ne~ative DeclaraCion
substantiating the foregoing findinys is on `ile in the City of Anaheim Planning
Department.
N~W, TfIEREFORE, 6c IT RESOL?~ED that the Anaheim City Planning Commission
does hereby grant subject Petttion for Conditional Use Permit, upon the following
conditions ~•rhich are hereby found to be a necessa ry prerequisite to the proposed use
of the subject property in order to preserve the safety and general ~~~elfare of the
Citizens of the City of Anaheim:
1. That rhe _>~;~;?;;y ~~;u~~,;~C siiaii ~~e brought up to the minimum
standards of the City ~of Anaheim, including the Unlform Eiuilding, Plumbing,
Electrical, Housing, Mechanical and Fire Cedes as adopted by the City of Anaheim.

with plans and specificat;ons on fiie with the City of .4naheir~ markeci Exhibit Plos, ~
~nd Z.
3. That Condition No. 1 and 2, ahove-mentioned, shall be complied with
prior te the commencement of the activity authorized under t~iis resolution, or
wi;hin a period of onc year from date hereof, ~~~hichever occurs flrst, or such further
time as tlie Planning Commission may grant.
~E. That tne Maximum occupancy f~r this board and care facllity shall be
fifteen (15) persons.
5. That no televisior, sets or other noise producin~ cievices shal! hP used
autdoors on the patio after 1Q;3~ p.m,
BE 17 FURTNER RESOLVED that the Anahelm City Planning Commission ~'oes hereby
flnd and determine tliat the adoption of this P,esolu*ion is expressiy predicated upon
aPplicant~s compliance with each and a11 of the conciitions hereinabove set forth,
Should any condition or any part thereof, be declared invalid or unenforceable by the

fir,al judyment of any court of competent jurisdiction, then this Resolution, and any
approvais herein c~ntained, shall be d~emed null and void.
