RESOLUTION NO. 7lR- 71
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ANAHEIM AUTHORIZING AND DIRECTING
THE MAYOR AND CITY CLERK TO EXECUTE AN
AGREEMENT PERTAINING TO THE ilKERSTEN WELLII.
WHEREAS, Dr. Erwin H. Kersten is the owner of a water
well located adjacent to the Anaheim Municipal Golf Course;
and
WHEREAS, the City desires to use said well and assume
the water fees, assessments, insurance and taxes (except real
property taxes) thereon: and
WHEREAS, the owner thereof is willing to permit the
City to use such well in consideration of the payment of seventy-
five cents (7S~) per acre feet, subject to the terms of that
certain agreement submitted herewith; and
WHEREAS, said agreement has been reviewed by the
Offices of the City Attorney and the City Council finds that it
is in the best interests of the City to enter into such agree-
ment.
NOWf THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that the Mayor and City Clerk be and they
are hereby authorized and directed to execute on behalf of the
City of Anaheim that certain agreement with Dr. Erwin H. Kersten
pertaining to the use of the HKersten tt1ell" by the City of
Anaheim.
THE FOREGOING RESOLUTION is hereby approved and signed
by me this 16th day of February, 1971.
