OFFICF OF THF COUNTY RECORGER OF SAfD COUNTY. 41HEREAS, the City Planning Commission did held a public hearing at the Civic Ce~tEr in the City of AnahPim on Feb~uary 9, 1981, at 1:30 P.m., noYice nf said public hearing hziving been duly given as required by iaw and in accordance with the provisions of the I~naheim Municipal Code, Chapter 18,03, to hear and consider evidence for and against said proposed conditional use permit and to investigate and make findings and reconmendations in connection therewith; and WHEREAS, said Commission~ af~er due inspection, investtgatton and study made bv itself and in its behalf, and after due cnnsideratio~ of all evidence and reports ofTered at said he~aring, does find and determine the followinn facts: i. That: the proposed use is properly one for which a r.onditional use permit is authorized by Anaheim Municipal Code Section 18.Ei7.450.180 to ,oit: to permit an exterminatSng servi~ce in the ML (Indusf.riai, Limited) Zone. 2~ That the prop~sed use wili not adversely affect the adjoining land uses and the grcnath and development of the area in e-~hich it is pro~osed to be located. 3. That the size and shape of the site proposed for the use is adequate to allaw the full deve!opment of the proposed use in a manner not detrimental to the particular area nor to the peace, health, safety, and qenera1 welfa~e of the Citizens of the City of Anaheim„ 4. That the granting of the Conditionai Use Permit under the conditions imposed, if a~~y, will not be detrimental to the oeace, health, safety and general 4+elfare of the Citizens of the City of Anaheim, S. That Lhe traffic generated by the propused use arill not impose an undue burden upon the streets and higharays designed and improved to carry the traTfic in the area. ENVIROP~MENTAL IMPACT FINDIPJG: 7hat the Anaheim City Planning Coinmission has reviewed the proposa to permit an exterminatin~ service in the ML (Industrial, Limited) Zone on a rectangularly-shaped parcel consisting of approximately 4,7 acres, ha ving a frontage of approximately 330 feet on the ncr•th side of Winston Road having a maximum depth of approximately G20 feet and beinn locate~~ approximately 9B0 fee; east of the centerline of State College Boulevard (2221 East 411nston Road); and does hereby approve the Negative Declaration from the requ(rement to prepare an environmental impact report on the basis that there taould be no significant individual or cumulative adverse environmental impact due te the approval of this Negative Declaration since the Anaheim General Plan designates tne subject property for general industrial land uses commensurate ~~ith the proposa?; that no sensitive environmental impacts are involved in the proposat; that the Initial Study submitted by the petitioner indicates no significant individual or cumulative adverse environmental impacts; and that the Negative Deciaration substantiating the foregoing findings is on file in the City of Anaheim P]ann~ng Department. Pl041, THEREFORE, BE IT RESOLVED that the Anaheim City Planning Commission d~es nerehy grant sub;ect Petition for Conditional Use Permit, upon the foiiowing conditions which are hereby found to be a necessary prerequisite to the proposed use of the subject property in ordr_r to preserve the safety and ~eneral ~•ielfare of the Citizens of the City of Anaheim: 1. That a list of all chemicals :o he stored on the premises sha1.1 be submitted to and approved hy the Chief of thr Fire Department prior to occupancy of the buildtng, 2. That suhjecL property shall be develooe~ suhstanttallv in acc~~~anc~ with p(ans and specifications on file witii the C~ty of Anaheim merked Exhibit tdos. 1 through 3. BE IT FURTHER RESOLUED that the Anaheim City Planning Commission does hereby find and determine that adoption of this Resolution is e~pressly predicated upon applica~t's compliance a~ith each and all of the conditions hereinabove set forth. Should any such condition, or any part thereof, be declared invalid or unenforceable by the final judgment of any court of competent jurisciiction, then this Resolution, anu any appr•ovals herein contained, shall be deemed nuil and void.
