92806, agent, of certain real pro~erty situated i~ thP City nf /lnaheim, County of
Orange, State of California described as:
A por~ion of Lot 7, Block 5, o` the Golden State Tract, shown as
Parcel 4, of Parcel Ptaps, Bool< 50, pane 17, Gfficial Rer_ords of
Orange County, Callfornia.
WHEREAS, the City Planning Commissicn did hold a puhiic hearing at the City
Hall in the City of Anaheim on January 12, 1981, at 1:3~ p.m., notice of said public
hearing having been duly given as required hy la~•~ and in accordance with the
provisions of the Anaheim Municipai Code, Chapter 1~3.~13, t~ hear and cons~der
evidence for and against said proposed variance and to investic~ate and make findinqs
and recanmendations in connection thereo-,ith; and
WHEREAS, said Commissionr after due inspection, investi~ation and sti.idy made
by itself and in its behalf, and after due cnnsid~ration of all evidence and reporis
offered at said hearing, does find and determine the followina facts:

2. That the above-mentioned wa~ver for an off-site sign (billboard)
advertising a nearby business is hereby denied on the basis that the petitioner did
not demonstrate that a hardship exists due to the size9 shape, locatior or topography
of subject property and approval would set an undesirahle prPCPdent in the northeast
industrial area.
3. That there are no exceptional or extraorriinary circumstances or
conditior.s applicable to thc property invoived or to the intended use of the property
that do not apply generally to the property or class of use in the same vicinitv and
zone.
4. That the requested variance is not necessary Tor ttie. preservation and
enjoyment of a substantial property right possessed !~y other prooerty ir the same
vicinity and zoney and denied to the ~roperCy in question.
5. That the requested variance will he materlally detrimental to the
public welfare or injurious to the property or improvements in such vicinity and zone
in which the property is located.

of Categorlcal Exemptions, Class 3, as defined in the State EIR f,uidellnes and is,
therefore, categoricaliy exempt rrom the requirement to prepare an EIR.
(JOW, THEREFORE, BE I7 RESOLVED that the AnahePm City Planning Commission
does hereby deny subject Petition for Variance on the basis of the aforementioned
f(ndings.
