W4EREF~S, the City Planning Commission did hold a pui~lic hearing at the Civ:c Center in the City of Anaheim on March 'L3, 1981, at 1:30 p.m., notice of said public hearing having been duly given as required by la~~ and in accordance with the provisions of the Anaheim Municipal Code, Chapter 1~.03, to hear and consider evidence for and against said proposed reclassification and to investigate ~nd make ftndinas and recommendations in connection there~•~ith; and WHEREAS, said Commission, after due inspection, investlgation and s~udy macie by itself and in its behalf, and after due consideration of all evidence and reports offered at said hearing, does find and determine the followin~ facts: 'I. That the pe!itioner proposes reclassification of subject property from tiie RS-7200 (Residential, Single-Farrily) Zone to the C~ (Commercial, Office and Professional) Zone. 2, That the Anaheim General Plan designates suhject prooerty for lcw- density rPSidential land u~es. 3. That tfie proposed reclassification of subject property is hereby denied on the basis that it woul~l be "spot zoning" ~,ahich ~rould have a detrimental effect on the surrounding residen*_tal area and, furthermore, ~•rould set an undesirable precadent. 'v. That th~ proposed reclassification of su'~ject ,~ro~erty is not necessary and/or desirable for the orderly and proper development of tFA community. 5. Tha; the proposed reclassification of subject property does not properly relate to the zones and their permitted uses locally established in close pr~ximity to subject property and to the zones and their permitted uses generally es~ablished throughout the community. 6. That no one indicated Cheir presence at safd public hearing in opposition; and that no correspondence t•ras received in opoosition t~ the subject petition. E~IVIROP~FIE~~TAL IMPFlCT FIFlDIWG: That the Anaheim City Planning Commissior, has rnviewed tFie proposal to reclassify suhject property fror: the RS-72^~ (Residential, Sirtgle°Family) Zone to the CO (Commercial, Ufftce anei Professional) Z'one to permit PC81-5; commercial use of residential structure witn ~•raivers of permitted location of required parking and minimum landscaped setback on a rectangular]y-shaped parcel of land consisting of approximately 0.1~ acre located at the southti•~est corner of Ball Road and 4lalnut Street (1200 41est E3a11 Road), and does hereby approve the Negative Der_iaration from the requirement to prepa re an environmental impact report on the basis that tliere a~ould be no significant individual or cumu)atfve adver=_e environmental impact due te the apFroval of this Negative Declar•ation since the Anaheim General Plan designates the subject pr•operty for loa~-ciensity residential land uses commensurate with the proposal; that no senslYive envlrqnmental lmpacts ar~ involved In the propas~l; that the lnitial Study su~nitted by the petitioner indicates no significant individ;ial or cumulative adverse environmental impacts; and that the Negative Declaration substantiating the foregoinq findings is on file tn the City of Anaheim Planning Department.
