PC81.-1~ A RESOLUTIOM OF THE ANAHEIM CITY PLANNIN~ COMMISSIOM " THAT PETITION FOR CONDITIONAL USE PER~41T N0, 22~15 3E GRANTE~ WHEREAS~ the Anahefm C(ty Planning Commission did recetve a verified Petition for Conditional Use Permit from SO'1FARREL, INC., 3~~~ East La Jolla Street, Anaheim, Californla, 923~6, owner, and BUSIMESS PROPERTIES~ ATT: DOPI PAUL, ~E440 Von Karman Avenue, DJe~aport Beach, California 92E6~, aqent, of certain real property situated in the City of Anaheim, County ofi Orange, State of California, described as: The West one-half of Lot 8 in Block 5 of the Golden State Tract, in the City of Anaheim, County of Orange, State of Caltfornia, as shown on a map thereof recorded in Book 4, Pages ~6 and 67, Miscellaneous Maps, Records of said Orange Count•/. Excepting therefrom the Westerly 40 feet. IJHEREAS, tlie City Planning Commission did hold a public heartng at the Ctty Hall in the City of Anaheim on January 25, 19II2~ at 1:30 p.m., nottce of said public hearing having been duly given as required by laa~ and in accordance with the provisions of the Anaheim Municipal Code, Chapter 1$.03, to hear ?nd consider evidence for and against said proposed condittonal use permit and to investigate and make findings and recommendations in connectton therewith; and WHEREAS, said CommtssEon, after due ~nspection, investigation and study made by itself and in its behalf, and after due consideratTon of all evidence and reports offered at said hearing, does find and determine the following facts: T. That the proposed use is properiy one for whicf~ a condittonal use permit is authorized by Anaheim Municipal Code Section 1$.61.050,460 and 18.61.050.120 to ~•1it: to permit a television transmission station wPth a 250-foot high broadcasting tower in the ML (Industrial~ Limited~ ~~ne. 2. That the proposed use is hereby granted subject to approval of the 250- foot high broadcasting tower by the Fede~al Aviation Administration. 3. That the proposed use will not adversely affect the ad.joining land uses and the ~rowth and development of the area in which tt is proposed to be located. 4, That the size and shape of the site proposed For the use 1s adequate to allow the full devetopment of the proposed use in a manner not detrimental to the particular area nor to the peace, health, safety, and gener3l welfare of the Cittzens of the City of Anaheim, 5. That the granting of the Conditional tlse Permit under the condittons imposed, if any, will not be detrimental to the peace, health, safety and general welfare of the Citizens of the City of Anaheim, 6. That no one tndicated their presence at said public hearing in opposii.ion; and that no correspondence ~vas recetved in opposition to the subject petltion. ENVIR~N~IEPITAL It1PACT FINDING: That the Anaheim City Planning Commisslon has revte~aed the proposal to permit a television transmission statton ~~~ith a 250-foot hlgh broadcasting tower in the 11L (Industrtal, Limited) Zone on a rectangularly- shaped parcel of land consisting of approximately 4.09 acres, having a frontage of approximately 290 feet on the north side of ~4lraloma Avenur, appro~imately 705 feet east of the cPnterline of Red Gum Street; and does hereby approve the Negative Declaration fr~m the requirement to prepare an environmental impact report on the basis that there ~~ould be no significant individual or cumulattve adverse environmental impact due to the aoproval of this Uegative Declaration stnce the Anaheim General Plan designates the subject property for aeneral Industrial land uses commensurate with the proposal; that no sensitive environmental impacts are involved in ti~e proposal; that the Initial Study submitted by the petttioner indicates no significant tndividual or cumulatTve adverse environmental impacts; and that the tJegative Declaration substantiating tlie foregoing findings is on file in the City of Anaheim Planning Department. tJOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planning Commission does hereby grant subject Petttion for Conditional Use Permit, upon the followtng condittons which are hereby found to be a necessary prerequisite to the proposed use of the subject property in order to preserve the safety and general welfare of the Citizens of the City of Anaheim: 1. Tiat all engineering requirements of the City of A~aheim along Miraloma Avenue including preparation of improvement plans and installatton of all improvements such as curbs and gutters, sidewalks, street grading and paving, drainage faciltties or other appurtenant ~a~rk, shall be complied with as required by the City Engineer and in accordance ~vith specifications on file in the Office of the City Engineer; that street lighttng facilities along Miraloma Avenue shall be installed as required by the Office of Utiltttes General Manager, and in accordance with specifications on f(le in the Office of Utilitles General 11anager; and/or that a bond, certificate of deposit, letter of credit, or cash, in an amount and form satisfactory to the City of Anaheim shall be posted ~aith the City to guarantee the instatlatton of the above-mentioned requtrements prior to occupancy. 2. That trash storage areas shall be provided in accordance with approved ~lans on file with the Office of the Executive Director of Public !:orks. 3. That fire hydrants shall be installed and charged as requtred and determtned to be necessary by the Chief of the Flre Department prior to commencement of structural framing. 4. ihat subject property shall be served by undergroun~ utilittes. ~. That dratnage of subject property shall be disposed of in a manner satisfactory to the City Engineer. -2- PC82-1Q 6, In the event that subject property is to be divlded for the purpose of sale~ lease, or financing, a parcei map, to record th~ approved divlsion of subject prope~ty shall be submitted t~. and approved by the City of Anaheim and then be recorded in the office of the Orange County Recorder, prtor to issuance of a uuilding permit. 7. That the o~•m er(s) of subject property shall pay appropriate drainage assessment fees to the City of Anaheim as determtned by the City Engineer prior to issuance of a building permit, 8. That the owner(s) of suhject property shali pay the traffTc signal assessment fee (Ordtnance tJo. 33~6) in an amount as determined by the City Council, for industrial buildings prior to the issuance of a buiidPng permit. °. That appropriate c•~ater assessment fees as det~rmined by the Offtce of Utilittes General Manager shali be patd to the City of Anaheim prtor to the issuance of a building permtt, 10. Tliat the design and location of vehicular access from Mlraloma Avenue shall be approved by the City of Anaheim Traffic Engineer. 11. That the oam er(s) of subject property shall submit a letter requesting the termination of Conditional Use Permit tJo. 1171 to the Planning Department. 12. That the owner(s) of subject property shal) suhmit 4~ritten evidence to the Planning Departm~nt that the Federal Aviation Admintstratton has a~proved the 250-foot high broadcasting ta~er. 13. That the existing catch basin at the drive~vay shown on the submttted exhfbits on the o-~est side of the parcel shall be relocated to the satisfaction of the City Engineer. 14, That subject property shall be daveloped substantially in accordance with plans and specifications on file a~ith the City of Anahetm markEd Exhibit Nos. 1 and 2. 15. That Condition Nos. 1~ 10, 11 and 12, a6ove-mentioned, shall be complled with prior to the cemmencement of the activity authorized under this reso)ution~ or prior to the time that the buil~iing permit is issued, or within a period of one year from date hereof, whichevPr occurs ftrst, or such further time as the Planning Commission may grant. 16, That Condition Nos. 2, 4, 5, 13 and 14~ above-mentioned, shall be complied witli prior to final building and zoning inspections. BE IT FURTHER RESOLVED that the Anaheim City Planning CoRmisston does hereby find and determine that adoption of this Resofution ts expressly predicated upon applicant~s compliance ~•~ith each and all of the condittons herelnabove set forth.
