PC80-218 IIJ CONNECTION WITH CONDITIONAL USE PERMIT N0. 2149 WHEREAS, the petitioner submitted a request for an amendment to the conditions of approval contained in Planning Commission Resolution No. PC80-218 adopted in connection with Conditional Use Permit No. 2149, which was granted by the Planning Commission on De~ember l, 1980, to permit the construction of recreational facilities in conjunction with an existing educational institution on an irregularly-shaped parcel of land consisting of approximately 5.85 acres, having a frontage of approximately 336 feet on the north side of Katella Avenue, and being located approximately 830 feet east of the centerline of Harbor Boule- vard (Melodyland Christian Center); and WHEREAS, the petition request amendment of the following condition con- tained in the above-referred to resolution: "i. That all engineering requirements of the City of Anaheim along Katella Avenue including preparation of improvement plans and inst~llation of all improvements such as curbs and gutters, sidewalks, street grading and paving, drainage facilities or other appurtenant work, shall be complied with as required by the City Engineer and in accordance with specifications on file in the Office of the Gity Engineer; that street lighting facilities along Katella Avenue shatl be installed as required by the Office of Utilities Gene~al Manager, ar~d in accordance with specifications on file in the Office of Utilities General Ptanager; and/or that a bond, certificate of deposit, letter of credit, or cash, in an amount and form satisfactory to the City of Anaheim shall be posted with the City to guarantee the installation of the above-mentioned requirements prior to occupancy". WHEREAS, the Anaheim City Planning Commission did ho]d a public hearing at the Civic Center in the City of Anaheim on June 2, 1982, at 1:30 p.m., notice of said public hearing having been duly given as required by law and in accordance with the provisions of the Anaheim Municipal Code, to hear and consider evidence for and against said proposal to amend the conditions of approval of Conditional Use Permit No. 2149, and to investigate and make findings and recommendations in connection therewith; and 1. That no one indicated their presence at said public hearing in opposition; and that no correspondence was received in opposition to the subject request. 2. That the Commission could not find justification for amending said condition on the !.~asis that the owners of all other properties in the City of Anaheim are required, under similar circumstances, to install and/or bond fo said improvements. 3• Tha.*. due to the existing unsafe conditir~ of Katella Avenue (the travel lanes are not properly aligned) along the 300-foot frontage of subject property, said improvements should be made because Katella Avenue is one af the most congested arterial streets in this commercial/recreation area. NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planning Co~nmission does hereby deny amendment of Resolution No. PC80-218, and the condition sliall remain as originally approved and must be complied with.
