Coronado "G", Anaheim, California 928pCi, a9ent, of certain real property situated in the City of Analieim, County of Orange, State of California, described as: A PORTIO~! OF LOT 7, BLOCI: 5, OF TfiE GOLDEtJ STATE TRACT, SfiQ4l~! AS PARCEL 4, OF PARC[L MAPS, BOOY. 50, PAGE 17, OFFICIAL RECORDS OF ORANGE COUlJTY, CALIFORPIIA. SEE ATTACHED MARK[D EX4IRIT "A". WHEREAS, the City Planning Commission did hold a public hearing at the City liall in the City of Anaheim on June 14, 1982, at 1:30 p.m., notice of said public hearing having been duly given as required by la~o and in accordance with the provisions of the Anal~eim Plunicipal Code, Chapter 18.03, to hear and consider evidence for and against said proposed conditional use permit and to investigate and make findings and recommendations in connection therewitti; and WHEREAS, said Commission, after due inspection, invr_stigation and study made by itself and in its behalf, and after due consideration of all evidence and reports offered at said hearing, does find and determine the followtng facts: 1. That the proposed use is properly one for ~ahich a condittonal use permit is authorized by Anaheim Municipal Co~e Section 18.61.Oy0.601 to wit to permit automobile repair in an existing service station irt the ML (Industrtal, Limited) Zone. 2. That the proposed use is iie reby granted for a pertod of one (1} year from the date herein, to expire on June 14, 1983. 3• That the proposed use is hereby granted subject to the petitioner's stipulation at the public hearing that all automobile repair work shall be performed inside the buildtng. 4. That :he proposed use i~ill not adversely affect the adJoining land uses and the growtit and development of tfie area in which it is proposed to he located. 5. That the size and shape of the site proposed for the use is adequate to ailow the full development of the proposed use in a manner not detrimental to the particular area nor to the peace, health, safety, and general welfare of the Citizens of the City of Anaheim. 6. That the granting of ttie Conditional Use Permit under the conditions imposed, if any~ will not be detrimental to the peace, health, safety and general welfare of the Citizens of tfie City of Anaheim, PC32-11$ ~. 7. That the traffic generated by the proposed use will not impose an undue burden upon the streets and highways designed and improved to carry the traffic in the area. 8. That no one indicated their presence at said public hearing in opposition; and that no correspondence was received in opposition to the subject petition. ENVIRON~1EtJTAL IMPACT FINDING: That the Anaheim City Piann?ng Cornmission has reviewed the proposal to permit automobile repair in an existing service station in the ML (Industrial, Limited) Zone on a rectangularly-shaped parcel of land consisting of approximately 0.6 acre located at the northwest corner of Miraloma Avenue and Kraemer Boutevard (3093 East Miratoma Avenue); and does hereby approve the Negative Declaration from the requirement to prepare an environmenta] impact report on the basis that there would be no significant individual or cumulative adverse environmental impact due to the approval of this Negative Declaration since the Anaheim Generai ?lan designates the subject property for general industrial land uses commensurate with the proposal; that no sensitive environmental impacts are involved in the proposal; that the Initial Study submitted by the petitioner indicates no significant individual or cumulative adverse environmental impacts; and that the Negative Declaration substantiating the foregoing findings is on file in the City of Anaheim Ptanning Department. NOW, THER[FORE, DE IT RESOLVED Chat the Anaheim City Planning Commission does hereby grant subject Petition for Conditional Use Permit, upon the following conditions which are hereby found to be a necessary prerequisite to the proposed use of the subject property in ordar to preserve the safety and general welfare of the Citizens of the City of Anaheim: 1. That trash storage areas shall be provided in accordance with approved plans on file with the Office of the Executive Director of Public Works. 2. That the owner(s) of subject property shall submit a letter requesting termination of Conditional Use Permit Nos. 2035 and 2218 and Variance No. 32UU to the Planning Department. 3. That the petitioner shall obtain approval for temporary use of the trailer located on the property in canformance with Council Policy Number 529, within a period of 60 days from the date herein. 4. That subject property shall be developed substantially in accordance with pians and specifications on file with the City of Anaheim marked Exhibit No. t. $. That Condition Nos. 1 through 4, above-mentioned, shall be completed prior to the commencement of the activity permitted by this conditional use permi t. 6. That the use is hereby granted for a period of one (1) year from the date herein, to expire on June 14, 1933. BE IT FURTIIER RESOLVED that the Anaheim City Planning Commission does here6y find and determine that adoption of this Resolution is expressly predicated upon applicant's compliance with each and all uf the conditions hereinabove set forth. Should any such condition, or any part thereof, be declared invalid ur unenforceable -2- PC82-118 ~ by the final judgment of any court of competent jurisdiction, then this Reso)ution, and any approvals herein contained, shall be deemed null and void.
