PC82-149 A RESOLUTION OF THE ANAHEIM CITY PLANNING COMMISSION THAT PETITION FOR VARIANCE NO. 3?85 BE DENIED WHEREAS, the Anaheim City Planning Commi.ssion did receive a verified Petition for Variance from STEVE L. PETERSON AND DEBRA H. PETERSON, 2333 Puritan Lane, Anaheim, California 92806, owners, of certain real property situated in the City of Anaheim, County of Orange, State of California described as: LOT 13 OF TRACT NO. 1987 AS PER MAP RECORDED IN BOOIC 106, PAGES 13, 14 AND 15 OF MISCELLANEOUS MAPS, IN THE OFFICE OF THE RECORDER OF SAID COUNTY. WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City of Anaheim on July 26, 1982, at 1:30 p.m., notice of said public hearing hav~ng been duly given as required by law and in accordance with the provisions of the Hnahei:n Municipal Code, Chapter 18.03, to hear and consider evidence for and against said proposed variance and to investigate and make findings and recommendations in connection therewith; and WHEREAS, said Commission, after du~ inspection, investigation and study made by itself and in its behalf, and after due consideration of al2 evidenr.e and reports offered at said hearing, does find and determine the following facts: 1. That the petitioner proposes waivers of the following to construct a qarage or carport: (a) SECTION 18.26.063.011 - Minimum landscaped setback. (25 feet for front-on garage required; 5 feet proposed) (b) SECTION 18.26.066.010 - Minimum nuatber and type of parking spaces and 18.26.066.011 (4 on-~ite spaces, 2 enclosed in a garage required; 2 spaces in a carport proposed) 2. That the above-mentioned :~aivers are hereby denied on the basis that the petitioner did not demonstrate that a hardship exists and that the property does not differ from other property in the same zone and vicinity as to size, shape, topography, location or surroundings; and that approval would set an undesirable precedent in the City of Anaheim. The existing converted garage shall be reconverted for use as a 2-car qaraqe within a period of ninety (90) days from the date herein. 3. That there are no exceptional or extraordinary circumstances or con3itions applicable to the prvperty involved or to the intended use of the property that do not apply qenerally to the property or class of use in the same vicinity and zone. PC82-149 ;,: ~:,. ,""`., ~..MW 4• ^hat the requested variance is not necessary for the preservation and enjoyment of a substantial property ri.ght possessed by other property in the same vicinity and zone, and denied to the praperty in question. 5• That tlie requested variance will be materially detrimental to the public welfare or injurious to the property or improvements in such vicinity and ~one in which the property is located. 6• That eight (8) persons inflicated their gresence at said public heariny in opposition; and that no correspondence was received in opposition to subject petition. ENVIRONMENTAL I(~ACT FINDING: That the Anaheim City Planning Commission has reviewed the proposal to construct a garage or carport with waivers of mini.mum landscaped setback and minimum number and type of parking spaces on a rectangularly-shaped parcel of land consisting of approximately 7970 square feet located at the northwest corner of Puritan Lane and Peregrine Street, and further described as 2333 Puritan Lane;and does hereby approve the Negative Declaration from the requirement to prepare an environmental impact report on the basis that there would be no significant individual or cumulative adverse environmental impact due to the approval of this Negative Declaration since the Anaheim General Plan designates the subject property for low-density land uses commensurate with the proposal; that no sensitive environmental impacts are involved in the proposal; that the Initial Study subniitted by the petitioner indicates no significant individual or cumulative adverse environmental impacts; and that the Negative Declaration substantiating the foregoing findings is on file in the City of Anaheim Planning Department. NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planning Commission doe~ hereby deny subject Petition for Variance on the basis of the aforementioned findings. i•HE FOREGOING RESOLUTION is signed and approved by me this July 26, 1982. ~ .
