PC82-163 A RESOLUTION OF THE ANAHEIM CITY PLANNING COMMISSION THAT PETITION FOh CONDITIONAL USE PERMIT NO. 2368 BE DENIED WHEREAS, the Anaheim City Planning Commission did receive a verified Petition for Condiiional Use Permit from PREDERICK R. AND RUTH I'. SACHER, Box 249, E1 Toro, California 92630, owner, and UONAVON A. VAN OVER, 11691 New Zealand, Cypress, California ~0630, aqent of certain real property situated in the City of Anaheim, County of Orange, State of California, described as: THAT PORTION OF LOT 22 IN BLOCK IC OF THE KR]~ENiER TRACT~ AS SHOWN ON A MAP RECORDED IN BUOK 12, PAGES 87 AND 88 OF MISCELLANBOUS RECORDS OF LOS ANGELES COUNTY, CP.LIFORNIA~ DESCRIBED AS FOLLOWS: PARCLZ B~ AS SHOP7N ON A MAP FILED IN BOOK 60, PAGE 45 OF PARCEL MAPS, IN THE OFFICE OF THE COUNTY RECORDER OF ORANGE C7UNTY~ CALIFORNIA. WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in tl,~ City of Anaheim on September 8, 1982 at 1:30 p.m., notice of said publir_ hearing having been duly given as required by law and in accordance with ~e provisions of the Anaheim Municipal Code, Chapter 18.03, to hear and consider evidence for and against said proposed conditional use permit and ~o investigate and make findings and recommendations in connection therewith; and WHEREAS, said Commission, after due inspection, investigation and study made by its~lf and in its behalf, and after due consideration of all evidence and reports offered at said hearing, does find and 3etermine the following facts: 1. That the proposed use is properly one for which a conditional use permit is authorized by Anaheim Municipal Code Section 18.61.050.605 to wit to permit retail sales of sporting goods in the ML (Industrial, Limited) zonp• 2, That the proposed use is hereby denied on the basis that it does not primarily serve and is not compatible with the surrounding industrial area. 3. That the proposed use will adversely affect the adjoining land uses and the growth and development of the area in which it is proposed to be located. 4. That the size and shape of the site proposed for the use is not adequate to allow the full development of the proposed use in a manner not detrimental to the particul.ar area nor to the peace, health, safety and general welfare of the Citizens of the City of Anaheim. 5. That the qranting of the Conditional !JSe Permit under the con~itions imposed, if a•~y, will be detrimental to the peace, health, safety anu general welfare of the Citizeas of the City of Anaheim. #0194I PC82-163 6. That the traffic generated by the proposed use will impose an undue burden upon the streets and highways desi.gned and improved to carry the trafPic in the area. ~• That no one indicated their presence at said public hearing in opposition; and that no correspondence was received in opposition to the subject petition. ENVIRONMENTAL IMPACT FINDING: That the Anaheim City Planning Commission has reviewed the proposal to permit retail sales of sportinq goods in the ML (Industrial, Limited) Zone on an irregularly-shaped parcel of land consisting of approximately 2.0 acres, having a frontage of approximately 375 feet on the south side of La Palma Avenue, and further described as 2872 East La Palma Avenua; and does hereby approve the Negative Declaration from the requirement to prepare an environmental impact report on the basis that there would be no significant individual or cumulative adverse environmental impact due to the approval of this Negative Declaration since the Anaheim General Plan designates the subject property for general industrial land uses conmensurates witr the proposal; that no sensitive envi-onmental impacts ?re involved in the proposal; that the Initial Study subm~tted by the petitioner indicates no siynificant individual or cumulative adverse environmental impacts; and that the Negative Declaration substantiating the foregoing findings is on fiZa in the City of Anaheiin Planning Department. NUW; THE~EFORE, BE IT RESOLVED that the Anaheim City Planning Commission does he=eby deny subject Petition for Conditional Use Permit on the basis of the aforenentioned findings.
