PC82-185 ~ A R~SOLUTION OI' THE F.NAHEIM CITY PI,pNN2NG COMMIggION THAT PETITION FOR CONDITIONAL USE PER[41T NO. 2373 B~ D~NIED ~, i WHEREAS, the Anaheim City Planning Cor,vnission did receive a verified Petition f-or Conditional Use Permit from IHERH~ ~,2 ATA, ?.6371 Avery Parkway, , Mission Viejo, California 92675, o~er, and TALAT RADWAN, 26371 Avery Parkway, Mission Viejo, California 92675, agent of certain real property situated in the City of Anaheim, County of Orange, State of California, described as: THE SpUTH 160 FEET OF THE EAST 115 FEET OF LOT 67 OF i TRACT NO. 2773, AS SHOWN ON A M1,p PAGES 24, 25 AND 26 OF MISC~LLANEOUgO Mppg IN BOOK 116, ' SAID COUNTY. . ~CORDS OF WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City of Anaheim on Se.ptember 8, 1982 at 1:30 p.m., notice of said public hearing having beer. duly qiven as required by law and in accordance with the provisions of the Anaheim Municipal Code, Chapter ].8,03, to hear and consider evidence for and against said proposed conditional use permit and to investigate and make findings and recornmendations in connection therewith; said public hearinq having beer, continued to the Planning Commission meeting of October ~}, 1982• and ~E~S, said Commission, after due in~pection, investigation and study made by itself and in its behalf, and after due consideration of all evidence and reports offered at said hearing, does find and determine the following facts: 1• That the proposed use is properly one for which a conditional use permit is authorized by Anaheim Municipal Code Section I8,Q3,03Q.OI0 to wit: to permit a conveaience market with gasoline sales z• That the proposed use will adversely affect the adjoining land uses and the qrowth and developr.i2nt of the area in which it is prcposed to be located. 3• That the size and shape of the site proposed for the use is not adequate to allow the full c~evelopment of the proposed use in a manner not detrimental to the particular area nor to th? peace, heal~h, safety and general welfare of the Citizens of the City of Anaheim. 4• That the granting of the Conditional Use Permit under the conditions imposed, if any, will be detrimental to the peace, health, safety and general welfare of tne Citizens of the City of Anaheim. 5• That the traEfic generated by the proposed use will impose an undue burden upon the streets and highways de~igned and improved to carry the traffic in the area. 02462 J PC82-186 i --. ~. ENVIRONMENTAL, TMPACT FINDING: That the Anaheim City Plazning Commission has reviewed the proposal to permit a convenience market with gasoline sales on a rectangularly-shaped parcel of land consisting of approximately 0.42 acre having a frontage of approximately 160 feet on the west side of Arookhurst Street, and further described as 1725 South Brookhurst Street; and does hereby approve the Negative Declaration from the require~ent to prepare an environmental impact report on the basis that there would be no significant i.ndividual or cumulative adverse environmental i~~pact due to the approval of this Negative Declaration since the Anaheim General Plan designates the subject property for general cor.unercial land uses commensurates w3.th the proposal; that no sensitive environmentai impacts are involved in the proposal; that the 7nitial Study submitted by the petitioner indicates no significant individual or cumulative adverse environmental impacts; and that the Negative Declaration substantiating the foregoing findings is on file in the City of Anaheim Planning Department. NOW, THEREFORE, BE IT RESOLV~D that the Anaheim City Planning Commission r•.oes herebp deny subject Petition for Conditional Use Permit, on the basi.s of the aforementioned findings.
