Llasiien, i2<<0 S. State College doulevard, llnaheim, California ~2~06, agent of cert~in real property situated in the City of Anaheim, County of Orarr,e, State of California, described as: Lot G of Tract P~o. ;Q91, as per map recorded in Oook ~2. " qes 48 and 1E9 of ~1iscellaneous Itaps, in tfie Office of the Count ~ scorder of said County. ldIIEREAS, the City Planning Commission did hoid a public hearing at the City Hall in the City of Rnaheim on January 11, 1~82, at ~:3o p.M., notice of said public hearing having been duly ~iven as re~uired by law and in accordance with the provisions of the Anaheim Ftunicipal Code, Chapter 1$.03, to hear and consider evidence for and against said proposed conditional use permit and to investigate and make findings and recommendations in connection there~•lith; and said public hearing having been continued from the meeting of December 28, 19F31; and WfiEREAS, said Commission, after due inspection, investigatinn and study made by itself and in its behatf, and after due consideration of all evidence an~ reports offered at said hearing, does find and determine the following facts: 1. That the proposed use is properly one for ,~hich a conditional use permit is authorized by A.naheim Municipal Code Sectdon 1f~.n3.f13~.010 to wit: To permit a convenience market a~ith gasoline sales. 2. Ttiat the proposed use is hareby denied c~n the basis tliat approval coutd set an undesirable precedent and on the basis that the size of the parcel (135'x135') is not adequate to accommodate the dual use of a conventence market and gasoline sales. 3. That the proposed ~se will adversely affect the adjoining land uses and the growth and dcvelcnment of the area in o-~hich it is proposed to be located, ~!. That the size and sh~pe of the site proposed for the use is not adequate to allow the full development of the proo~sed use in a manner not detrtmental to the particular area nor to the peace, health, safety, and general welfare of the Citizens of the City of Ananeim. 5. That the granting of the Conditianal Use Pernit will be detrimental to the peace, health* safety and general welfare of the Citizens of the City of Anaheim. 6, That the traffic generated by the proposr,d use wtll impose an undue burden upon the streets and higtx~ays designed and improved to carry tne traffic in the area. PC82-2 7. That no one indicated their prr.sence at said public hearing in opposition; and that no correspondence was n.ceived in oprosition to the subject peti tion. ENVIRONt1EtlTAL INPACT FItdDItIG: That the Anaheim City Planning Commission has revie+~~ed the proposal to permit a convenience market a~ith ~asoline sales on a rectangularly-shaped parcel of land consisting of approximately .45 acre located at the north,west corncr of 13a11 Road and C,i lbert Street (7-Eleven) (at 2~t~3 I~lest E3a11 Road); and does hereby approve the flegative ~eclaration from the requirement to prepare an environmental impact report on tl,e basis that there would be no significant individual or cumulativc aciverse environm~ntal im~+act d_ie to the approval of this Ilegative Declaration since the /lnaheim General Plan designates the subject property for general commercial land uses commensurate with the ~~roposal; that no sensitive environmental impacts are involved in the proposal; that the Initial Study submitted by the retitioner indicates no significant individual or cumulative adverse environmental impacts; and that the 17egative Qeclaration substantiating the fc~regoing findings is on file in the City of llnaheim Planning Denartment. tlOll, THEREFOP,E, CE IT P,ESOLUED that the Anaheim City Planning Commission does hereby deny subject Petition for Conditional t~se Permit on the basis of the aforementioned findings.
