PC82-203 A RESOLUTION OF THE ANAHEIM CITY PLANNING COMMISSION THAT PETITZON FOR VARIANCE NO. 3302 BE GRANTED WHEREAS, the Anaheim City Planning Commission did receive a verified Petition for Variance from MICHAEL GULAND, 20221 Prairie Street, Chatsworth , CAlifornia 91311, owner and WILLIAM RAFF, 20221 Prairie Street, Chatsworth, California 91311, agent of certain real property situated in the City of Anaheim, County of Orange, State of California described as: PARCEL 1, AS SHOWN ON A PARCEL MAP FILED IN BOOK 62, PAGE 1 OF PARCEL MAPS, IN THE OFFZCE OF THE COUNTY RECORDER OF SAID COUNTY. WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City of Anaheim on November 1, 1982, at 1:30 p.m., notice of said public hearinq having been duly given as required by law and in accordance with the provisions of the Anah~im Municipal Code, Chapter 18.03, to hear and consider evidence for and against said proposed variance and to investigate and make findings and reconunendations in connection therewith; and WHEREAS, said Commission, after due inspection, investigation and st+i3y made by itself and in its behalf, and after due consideration of all evidence and reports offered at said hearing, does find and determine the following facts: 1. That the petitioner p.ropose a waiver of the following to expand a self-storage facility: SECTION 18.06.060.038 - Minimum number of parking spaces and 18.61.066.050 (69 spaces required; 12 proposed) 2. That the above-mentioned waiver is hereby granted on the basis that the petitioner demonstrated that a hardship exists in that the nature of the proposed use consisting of a self-storage facility with individual rental storage units does not require the number of parking spaces required by code for regular warehouses and that denial would deprive subject property of privileges enjoyed by other properties in the same zone and vicinity. 3. That there are exceptional or extraordinary circumstances or conditions applicable to the property involved or to the intended use of the propezty that do not apply generally to the property or class of use in the same vicinity and zone. 4. That the requested variance is necessary for the preservation and enjoyment of a substantial property right possessed by other property in the same vicinity and zone, and denied to the property in question. 5. That the requested variance will not be materially detrimental to the public welfare or injurious to the property or improvements in such vicinity and zone in which the property is located. 6. ENVIRONMENTAL ZMPACT FINDING: That the Anaheim City Planning Commission has reviewed the proposal to expand a self-storage facility with wai•ver of minimum number of parking spaces on an irregularly-shaped parcel of land consistinq of approximately 2.8 acres, approximately 600 feet south of the centerline of La Palma Avenue an3 further described as 1050 North Armando Street; and does hereby approve the Negative Declaration from the requirement to prepare an environmental impact report on the basis that there would be no significant individual or cumulative adverse environmental impact due to the approval of this Negative Declaration since the Anaheim General Plan designates the subject property Eor general indus}rial land uses cowr.ensurate with the proposal; that that Initial Study submitted by the petitioner indicates no significant individual or cumulative adverse e~:vironmental impacts; and that the Negative Declaration substantiating the foregoing findings is on file in the City of Anaheim Planning Department. NOW, THEREFORE, BE IT RESOL~D that the Anaheim City Planning Commission does hereby grant subject Petition for Variance, upon the following conditions which are hereby found to be a necessarl prerequisite to the proposed use of the s:ibject property in order to preserve the safety and general welfare of the Citizens of the City of Anaheim: I. i'~iat the owner of subject property shall execute and record an agreement in a form approved by the City Attorney, agreeing to pay the cost of installation of all street improvements on that portion of La Mesa Avenue heretofore dedicated to the City of Anaheim for public street purposes. Said agreement shall be binding upon any succession in interest to said property and provide that such cost shall constitute a lien on the subject property until paid. 2. That proposed Huilding "F" shall be sprinklered unl.ess othe.rwise approved by the Chief of the Fir.e Department> 3. That a twenty (20) foot wide water easement shall be dedicated to the City of Anaheim as required by the Public Utilities General Manager. That subject property shall be developed substantially in accordance with plan:. and specifications on file with the City of Anaheim marked Exhibit No. 1. 5. That Condition No(s). 1 and 3, above-mentioned, shall be complied with prior to the coinmencement of the activity authorized under this res~lution, or prior to the time that the building permit is issued, or within a period of one year from date hereof, whichever occurs first, o~ such Eurther time as the Planning Commission may grant. 6. That Condition Nos. 2 and 4, above-mentioned, shall be complied c•~ith prior to final buil3ing and zoning inspections. -2- PC82-203 "'\ Fri`, BE IT FURTHER RESOLVED that the Anaheim City Planning Commission does hereby find and determine that adoption of this Resolution is expressly predicated upon applicant's compliance with each and all of the conditions hereinabove set forth. Should any such condition, or any part thereof, be declared invalid or ~iner.forceable by the final judgment of any court of competent jurisdiction, then this Resolution, and any approvals herein contained, shall be deemed null and void.
