PC82-205 A pFSOLUTION OF THE ANAHEZM CZT1 PLANNING COMMISSION ADOPTING AND RECO[~tENDING TO THE CITY COiJNCIL OF THE CITY OF ANAHEIM ADOPTION OF AN AN.ENDMENT TO THE LAND USE ELEMEN'P OF THE GENERAL PLAN DESIGNATED AS AMF.NDMENT NO. 179 - EXHIBIT "A" WHEREAS, the City Council of the City of Anaheim did adopt the Azaheim General Plan by Resolution No. 69R-644, showing the general description and extent of possible future development within the Citp; and Z9HEREAS, pursuant to a request fro~ the property owner for a General Plaa Amendment study, City staff prepared a General Plan Amendment fcr an area consisting of approximately 9.8 acres bounded on the north by Lincoin Avenue, on the east by Rio Vista Street, and on the west by the O:ange (57) Freeway; and WHEREAS, the Planning Department deemed it appropriate, pursuant to the provisions of the California Environmental Quality Act, that there are no significant envirorinental impacts and recommended that a Negative Declaration be approved; and WHEREAS, The Anaheim City Planning Commission did hold a public hearing at the linaheim Ci~ic Center, Council Chamber, 200 South Anaheim Boulevard, on November 1, 1982, at 1:30 p.m., notice of said public hearing k:aving been duly given as required by law and in accor3ance with the provisions of the Anaheim Munic:pal Code, to hear and consider evidence for and against said Amendment to the Anaheim General Plan, Land Use Element, and to investigate and make findings and recommendations in connection L•herewith; and subject petition having been continued to the meeting of Novec~er 15, 1982; and WHEREAS, SAZD Commission, after due consideration, inspection, investigation and study made by itself, and after due consideration of all evidence and reports offered at said public hearing, DOES HERSBY FIND: 1. That 18 persons indicated their presence in opposition to subject request at the November 1, 1982, public hearing; and that petitions containing approximately 74 signatures of persons in opposition were submitted at the November 1, 1982 public hearing; and that 7 persons indicated their presence in opposttion to subject request at the November 15, 1982 public hearing and the petitions containing approximately 170 signatures of persons in opposition were submitted at the November 15, 1982 public hearing. 2. That evidence was presented which substantiates the need for an amendment to the Anaheim General Plan, and it is deemed appropriate that "E~chibit A" be adopted, designating the entire area for medium density residential. #0329I PC82-205 ~(p(aa.cw~.~.._ . ... .....<.n.~' ,-~-, r...,. NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planning Commission has reviewed the proposal to change the current General Plan designation from General Comr.iercial to Medium Density Residential on a 9.8 acres bounded on the north by Lincoln Avenue, on the east by Rio Vista Street and on the west by the Orange (57) Freewa_:, and does hereby recommend to the City Council approval of the Negative Declaration from the requirement to prepare an environmental impact report on the basis that there would be no significant individual or cumulative adverse environmental impact due to the approval of this Negative Declaration since the Anaheim General Plan designates the subject property for general commercial land uses commensurate with the proposal; that no sensitive environmental impacts are involved in the proposal; that the initial study submitted by the petitioner indicates no significant individual cumulative adverse environmental impacts; and that the Negative Aeclaration substantiating the foregoing finding is on file in the City of Anaheim Planning Department. BE IT FURTHER RESOLVED THAT, pursuant to tlze foregoing findings, the ~ Anaheim City Planning Commission does hereby adopt and recommend to the City 1~ Council of the City of Anaheim adoption of General Plan Amendment No. 179 - Land Use Element, Exhibit A.
