A RESOLUTION Or THE ANAHEIM CITY PI,ANNING COMMISSION THAT PETITION FOR RECLASSIFICATIUN NO. 82-83-11 BE GRANTED WHEREAS, the Anaheim City Planning Commission did receive a verified petition for Reclassification from ANAHEIM REDEVELOPMENT AGENCY, 76 South Claudina Street, Anaheim, Califorr_ia, 92805, owner, and ANAHEIM CHAMBER OF COMMERCE, P. That the petitioner propcses reclassification of subject property from the CG (Commercial, General) Zono~ercial o£fic bui.lding,Office and Professioral) Zone to construct a 3-story Z, That the Anaheim General Plan designates subject property for general commercial land uses. 3, That thr pYOposed reclassification of subject property is necesaary and/or deairable for the orderly and proper development of the community. PC82-213 -2- ~ ~, 4• That the proposed reclassification of subject property does properly relate to the zones and their permitted uses locally established in close proximity to subject property and to the zones and their permitted uses generally established throughout the community. 5. That no one indicated their presence at said public hearing in opposition; and that no correspondence was received in opposi.tion to subject petition. ENVIRONMENTAL IMPACT FINDING: That the Anaheim City Planning Commission has reviewed the proposal to reclassify subject property from the CG (Commercial, General) Zone to the CO (Conunercial, Office and Professional) Zone to construct a 3-story commercial office buildina on a rectangularly-shaped parcel of land consisting of approximately 1.45 acres located at the southeast corner of Old Lincoln Avenue and Anaheim Boulevard; and does hereby approve the Negative Beclaration from the requirement to prepare an environmental impa.ct report on the basis that there would be no significant individual or cum~.tlative adverse environmental impact due to the approval of this Negative Declaration since i:he Anaheim General Plan designates the subject property for general commercial land uses commensurate with the proposal; that no sensitive environmental impacts are involved in the proposal; that the Initial Study submitted by the petitionzr indicates no significant individual or cumulative adverse environmental impacts; and that the Negative Declaration substantiating the foregoing findings is on file in the City of Anaheim Planning Depart^+ent. NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planning Commission does hereby grant subject Petition for Reclassification and, by so doing, that Title 18-Zoning of the Anaheim Municipal Code be amended to exclude the above-described property from CG (Commercial, General) Zone to the CO (COmmercial, Office and Professional) Zone upon the following conditions which are hereby found to be a necessary prerequisite to the proposed use of subject property in order to preserve the safety and general welfare of the Citizens of the City of Anaheim: 1• That trash storage areas shall be provided in accordance with approved plans oii file with the Office of the Executive Director of Public Works. 2. That 10-foot curb returns shall be provided at all driveway epproaches as required by the Cii:y Traffic Engineer. 3. That the petitioner and the City of Anaheim shall enter into a parking agrPement to provide 92 off-sit~~ parking spaces in a proposed ci~_y-owned parking Eacility to be constructed on the north side of Old Lincoln Avenue, eaet of subject property. 4. That the owner(s) of subject property shsll submit a letter requesting termination of Variance No. 132, to the Plan~iing Department. 5. That subject pruperty shall be developed substantiall;• in accordance with plans and ~pecifications on file with the City of Anaheim marked Exhibit Nos. 1 through 6. -9- PC82-213 `d3or .,~- ' ---- - ~ ,'`"~, 6. That prior to the introduction of an ordinance rezoning subject property, Condition Nos. 3 and 4, above-mentioned, shall be completed. The provisions or rights granted by this resolution ahall become null and void by action of the Planning Commission unless said conditions are complied with within one year from the date hereof, or such further time as the Planning Commission may grant. 7• That Condition Nos. 1, 2 and 5, above-mentioned, shall be compli.ed with prior to final building and zoning inspections. BE IT FURTHER RESOLVED that the Anaheim City Planning Commission does hereby find and determine that adoption of this Resolution is expressly predicated upon appiicant's compliance with each and all of the conditions hereinabove set fortli. Should any such condition, or any part thereof, be declared invalid or unenforceable by the final judgement of any court of competent jurisdiction, then this Resolution, and any approvals herein contained, shall be deemed null and void.
