PC82-58 RESOLUTION OF THE ANAHEIM CITY PLANNING COMMISSION REVOKING CONDITIONAL USE PERMIT N0. 2151 WHEREAS, Conditional Use Permit No. 2151 was granted by the Anaheim City Planning Commission by Resolution No. PC80-238 on December 15, ]980, to permit a used automobile sales lot with waiver of the minimum number of parking spaces for the 0.14 acre parcel located at the southeast corner of Anaheim Boulevard and Lemon Street, and further described as 1039 North Anaheim Boulevard (Su Casa Auto Sales); and WHEREAS, on April 5, ]9$2, the Planning Commission did conduct a duly noticed public hearing (continued from March 22, 1982) pursuant to provisions of Section 18.03.091 of the Anaheim Municipal Code to determine if grounds existed under provisions of Anaheim Municipal Code Section 18.03•092 for the termination of Conditional Use Permit No. 2151 for exercising said permit contrary to the express terms or condition, of approval; and WHEREAS, pursuant to notice of said public hearing, the property owner has requested that said perrt~it be revoked en the basis that the use of the property has been discontinued; and WHEREAS, after considering all of the evidence offered, the Planning Commission does hereby find that the permittee has exercised Conditional Use Permit No. 2151 cantra~y to the express terms and conditions of approval contained in Resolution No. PC80-23$ as follows: l. That permittee violat~d the permit which specified a maximum number of fifteen (15) for-sale cars on the premises at any one time by having an many as 25 vehicles for-sale on the premises at one time. 2. That permittee violated the permit which specified that all mechanical and related work shall be conducted wholly inside the building by continually repairing vehicles outside the building. 3• That the use for which approval was g~•anted has been so exercised as to be detrimental to the public health or safety or so as to co~stitute a nuisance by having an on-site camper being used as living quarters, by parking for-sale cars on Lemon Street and La Palma Avenue and on an adjacent commercial lot and by the reck- less movement of for-sale cars entering and exiting the site. NOW, THEREFORE, BE IT RESOLVED 6y the Planning Commission of the City of Anaheim that, for each of the reasons hereinabove specified, Conditional Use Permit No. 2151 be, and the same is hereby, revoked and Resolution No. PC80-238 is hereby declared null and void.
