WfiEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City of Anaheim on January 25~ 1q82. at 1:3n p.m,, notice of said public hearing having been duly given as required by laa~ and in accordance with the provislons of the Anaheim Municipal Code, Chaoter 18.~3~ to hear and constder evidence for and agalnst said proposed conditional use permit and to investigate and make findings and recommendations in connectton therew(th; and WHEREAS, said Commtsston, after due inspection, investigation and study made by itself and in its 6ehalf, and after due consideration of all evidence and reports offered at said hearing, does find and determine the following facts: 1. That the size and shape of the site proposed for the use is adequate to allow the full development of the proposed use in a manner not detrimenta) to the particular area nor to the peace. health, safety, and general welfare of the Citlzens of the Ctty of Analieim, 4, That the granting of the Conditional Use Permit under the conditions imposed~ if any, will not be detrimental to the peace~ heaith, safety and general welfare of the Citizens of the City of Anaheim. 5. That the traffic generated by the oroposed use will not Tmpose an undue burden upon the streets and highways designed and improved to carry the traffic in the area, E. PC82-8 ENVIRONMENTAL I!4PACT FI~~DING: That the Anahetm Citv Planning Comm(ssion has reviewed the proposal to permit on-sale beer and wine in a proposed restaurant on a rectangularly-shaped parcel of land consistin9 of approximately 0.72 acre having a frontage of approximately 130 feet on the south side of La Palma Avenue, approximately 290 feet ivest of the centerline of Magnolta Avenue (2632-34 West La Palma Avenue); and does hereby approva the Negative Declaration from the requirement to prepare an environmental impact report on the basis that there Nould be no stgnificant individual or cumulative adverse environmental impact du~ to the approval of this Negattve Declaration since the Anaheim General Plan designates the subject property for general commercial land uses commensurate with the proposal; that no sensitive environmental impacts are involved in the proposal; that the initlal study submitted by the petitioner indicates no stgnificant individual or cumulative adverse environmental impacts; and that the NegaYtve Declaration substantiating the foregoing ftndfngs is on file in the City of Anaheira Planning Department. NOW, THEREFORE~ BE IT RESOLVED that the Anaheim City Planning Commission does hereby grant subject PetitTon for Condttional Use Permit, upon the following conditions which are hereby found to be a necessary prerequisite to the proposed use of the subject property in order to preserve the safety and general ~~elfare of the Citizens of the City of Anaheim: That subject property shall be developed substantially in accordance with plans and specificatio~s on file with the City of Anaheim marked Exhibit Nos. 1 and 2. BE IT FLIRiHER RESOLVED that the Anaheim City Pianning Commission does hereby find and determine that adoptton of this Resoiution is exnressly predicated upon applicant's compiiance ~vith each and all of the conditions nereinabove set forth. Should any such condition, or any part thereof, be declared invaltd or unenforceabte by the final judgment of any court of competent jurisdlction, then this Resolution~ and any approvals he~etn contained, shall be deemed null and void.
