That the requested variance is necessary for the preservation and enjoyrtent of a substantial property right possessed by other property in the same vicinity and zone, and denied to the property in question. 6. That the requested variance ti•~ill not be materially detrimental to the public welfare or injurious to the property or improverrents in such vicinity and zone in which the property is located. 7• That no one indicated their presence at said public heartng in opposition; and that no correspondence a~as recei~•ad in opposition to the subject petition. ENVIRONFiE1JTAL IFIPACT FINDING: That the Anaheim City Planning Cortmission has revie~4ed the proposa] to construct a detached single-family d.~elling with waivers of minimum building site area, minimum floor area, minimum rear yard setback, and minimum numoer and type of parking spaces on a rectangularly-shaped parcel of land consisting of approximately 5,400 square feet, having a frontage of approximately 45 feet on the east side of Philadelphia Street, and being located approximately 137 feet south of the centerline of Sycamore Street (413 ~Jorth Philadelptiia Street); and does hereby appro~e the Plegati ve Declaration from T.he requi rement to prepare an envi ronmenta 1 i mpact report on the bas i s that there aroul d be no s i 9ni fi cant individual or cumulative adverse environmental irrpact due to the approval of this Paegati~,e Declaration since the Anaheim General Plan designates the subject oroperty for medium density residentia) land uses commensurate with the proposal; that no sensitive environmentat impacts are inw)ved in the proposal; that the Initial Study submitted by the petitio~er indicates no significant individual or cumulative adverse environmental impacts; and that the tlegative Declaration substantiating the foregoing findings is on file in the City of Anaheim Planning Department. NOIJ, TtIEREFORE, CE IT RESOLVED that the Anaheim City Planning Commission does hereby grant subject Petition for Variance, upon the following conditions which are hereby found to be a necessary prerequisite to the proposed use of the subject property in order to preserve the safety and general welfare of the Ci tizens of the City of Anaheim: 1• That the owner of subject property shall pay to the City of Anaheim the appropriate pa rk and recreation in-lieu fees as deternined to be appropriate by the City Council, said fees to be paid at the tirte the building permit is issued. 2. That the o~•mer(s) of subject property shall pay the traffic signal assessrtent fee (Ordinance tlo. 3896) in an amount as determined by the City Council, for each ne~•~ cAaelling unit prior to the issuance of a building permi t. -z- Pc8z-9r 3. That subject property shall be developed substantially in accordance with plans and specifications on file 4~ith the City of Anaheim marked Exhibit IJos. 1 through 3, !~• That Condition ~Jo. 3, above-mentioned, shall be complied with prior to firial building and zoning inspec ~ons. BE IT FURTHER RESOLVED that the Anaheim City Planning Cvmmission does t~ereby find and determine that the adoption of this Resolution is expressly predicated upon applicant's compliance with each and all of the condition~ hereinabove set forth. Should any condition or any part thereof, be declared invalid or unenforceable by the final judgment of any court of competent jurisdiction, then this Resolution, and any approvals herein contained, shall be deerr~ed null and wid.
