That the proposed use is properly one for ~•~hich a conditional use permit is authorized by Anaheim tiunicipal Code Section 18.61.050.050 to o~it to permit an automobile whoiesaling facility in the ~!L (industrial, Lir~ited) Zone. 2. That tfie proposed use will not adversely affect the adjoining land uses and the grn,,rth and develo~r~nr. of the area in ~•rhich lt is propesed to bc located. 3. That the size and shape of the site proposed for the ~se is adequate to allov~ the full development of the proposed use in a manner not ~!etrimental to the particular area nor to the peace, health, safety, and general ~.+elfare of the Citizens of the City of Anaheim. 4. That the granting of the Conditional Use Permit under the conditions irrposed, if any, wiil not be detrirrental to the peace, health, safety and general welfare of the Citizens of the City of Anaheim. 5. That no one indicated their presence at said public hearing in opposition; and that no correspondence was received in opposition to the subject petition. EPIVIROPlME~dTAL IMPACT FIFlD1PJG: That the Anaheim City Planning Cor.xnission has reviewed the proposal to permit an autortnbile a~holesaling facility in the ML PC82-98 .~ _ (Industriai, Limited) 'Lone on an irregularly-shaped parcel of land consisting of approximately 2.5 acres, having a frontage of approximately 2G0 feet on the east side of Clementine Street, and being located approximately 205 feet north of the centerline of Freedman Way( 1G16-1G18 South Clementine Street); and does hereby approve the Negative Declaration from the requirertent to prepare an environmental irtpact report on the basis that there would be no significant individual or cumulative adverse environmental irrpact due to the approval of this Negative Declaration since the Anaheim General Plan designates the subject property for commercial recreation land uses comnensurete a~ith the proposal; that no sensitive environmental impacts are involved in the proposal; that the Initiai Study submitted by the petitioner indicates no significant individual or cumulative adverse environmental impacts; and that the Negative Declaration substantiating the foregoing findings is on file in the City of Flnaheim Planning Department. iJOIJ, THEREFORE, BE IT RESOLVED that the Anaheim City Planning Commission dces hereby grant subject Petition for Conditional Use Permit, upon the foliowing conditions which are hereby found to be a necessary prerequisite to the proposed use of the sibject property in order to preserve the safety and general o-~elfare of the Citizens of the City of ~lnaheim: 1. That ail automobile storage and autorrobile sales shall be conducted entirely within the building. 2. That subject property shall be developed substantially in accordance a~ith ptans and specifications on file with the City of Anaheim marked Exhibit tJos . 1 th rough 3. BE IT FURTHER RESOLVED that the Anaheim City Planning Commission does hereby find and determine that the adoption of this Resolution is expressly predicated upon applicant's compliance a~ith each and all of the conditions hereinabove set forth. Should any condition or any part thereof, be declared invalid or unenfarceable by the final judgment of any court of competent jurisdiction, then this Resoiution, and any approvals herein contained, sliall be deemed null and void.
