A RESOLUTION OF THE ANAHEZM CITY PLANNING COMMISSION THAT PETITION FOR CONDITIONAL USE nERMTT N0. 2403 BE DENIED WHEREAS, the Anaheis City Planning Commission did receive a verified Petition for Conditional Use Permit from LA MANCHA DEVELOPMENT PROPERTIES, j' LTD., ~5720 Ventura Boulevard, #600, Encino, California 91436, owner, and UNITED OUTDOOR ADVERTISING, 1717 Orangewood Avenue, Suite A, Orange, California 92668, agent of certain real preperty situated in the City of Anaheim, County of Orange, State of California, described as: F''. ~.;:~. WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City of Anaheim on January 10, 1983 at 1:30 p.m., notice af said public hearing having been duly given as required by law and in accordance with the provisions of the Anaheim Municipal Code, Chapter 18.03, to hear and consider evidence for and against said proposed conditional use permit and to investigate and make findings and recommendations in connection therewith; and WHF.REAS, said Commission, aftcr due inspection, investigation and atudy made by itself and in its behalf, and after due consideration of all erideRCe ~nd reports uEfered ~t said f~earing, does find and determine the following facts: 1. That the proposed use is properly one for which a conditional sse permit is authorized by Anaheim Municipal Code Section 18.46.050.080 to wit: to permit a billboard in the CH (Commercial, Heavy) zone with Naivers of: (a) SECTIpN 18.05.144 - Maximwn display area (300 sq. ft. permitted; 672 sq, ft~ proposed) (b) SECTION 16.05,116.020 - Maximum height (27 ft. maximum within 300 ft. o± xny reaidential struc~•:.~ pernutted; + 42 ft. proposed within 275 feet of single-family dwellings) 2. That the requested waivers are hereby denied on the basis that no hardships were demonstrated pertaining to the property's size, location, shape, topoqraphy or surroundingg, #0420I PC83-10 /~ ~. 3. Tiiat the proposed use is nereby denied on the basis that it substantiaily exceeds Code requirements and would set an undesirable precedent in the surrrounding area. 4• That the proposed .se will adversely affect the adjoining land uses and the growth and development of the area in which it is proposed to be located. 5. That the size and shape uE the site proposed for the use is not adequate to allow the full development of the proposed use in a manner not detrimentai to the particular area nor to the peace, health, safetp and general welfare of the Citizens of the City of Anaheim. 6• That the qranting of the Conditional Use Permit under the conditions imposed, if any, will be detrimental to the peace, health, safety and general welfare of the Citizens of the City of Anaheim. 7• That the traff?c generated by the proposed use will impose an undue burden upon the streets and highways designed and improved to carry the traffic in the area. 8• That three persoas indicated their presence at said public hearing in opposition; and that no correspondence was received. in opposition to the subject petition. ENVIRONMENTAL IMPACT FINDING: That the Anaheim City Planning Commission has reviewed the proposal to permit a billboard in the CH (Commercial, Heavy) zone with waivers of maximum display area and maximum height on a rectangularly-shaped parcel of land consisting of approximately 0.51 acre located at the northwest corner of Ball Road and Heach Boulevard ~nd further described as 965-995 South Beach Boulevard; and does hereby approve the Negative Declaration from the requirement to prepare an environmental impact report on the basis that there would be no significant individual or cumulative adverse environmental impact due to th~ approval of this Negative Declaration since the A;:u'ieim General Plan designates the subject property for general commercial land uses commensurates with the proposal; that no sensitive environmental impacts are involved in the proposal; that the Initial Study submitted by the petitioner indicates no significant individual or cumulative adverse environmental impacts; and that the Negative Declaration substantiating the foregoing findings is on file in the City of Anaheim Planning Department. NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planning Commission does hereby deny subject Petition for Conditional Use Permit, on the basis of the aforementioned findings.
