YC83-lOl A RESOLUTION OF T~1° ANAHEIM CITY PLANNIP~G COMMISSIQN THAT PETITION FOR VARIANCE NO. 3332 BE GRANTED WHE~EAS, the Anaheim City Planning Commission did receive a verified Petition for Variance from SWU-WEI CHAI, ET AL, 921 South Elarbor Boulevard, Anaheim, California 92805, owners, and K. K. CHANG, P. O. Box 8064, Anaheim, California 92802, agent of certain real property situated i~ the City uf Anaheim, County of Orange, State of Californi.a described as: THAT PORTION OF LOT 28 OF ANAHEIM EXiENSZON, AS SHOWN ON A MAP OF SURVEY MADE BY WILLIAM HAMMEL AND FILED IN THE OFFICE OF THE COUN'PY RECORD~R UF LOS ANGELES COUNTY, CALIFORNIA, A COPY OF WHICH IS SHOWN IN BOOK 3, PAGE 163 AND FOLLOWING, ENTITLED "LOS ANGELES COUNTY MAPS", RECORDS OF SAZD ORANGE COUNTY~ MORE PARTICULARLY SHOWN AS PARCEL 1 ON A PARCEL MAP RECORDED IN BOOK 50, PAGE 5 OF PARCEL MAPS, RECORDS OF SAID ORANGE COUNTY. WHEREAS, the City Planning Commission did hold a public hearing at the Civic Center in the City of Anaheim on May 2, 1983, at 1:30 p.m., notice of said public hearing having been duly given as required by law and in accordance with the provisions of the Anaheim Municipal Code, Chapter 18.03, to hear and consider evidence :or and against said proposed variance and to investigate and make findings and recommendations in connection therewith; said public hearing having been continued to the Planning Commission meeting of June 1, 1983 and wHEREAS, said Commission, after due inspection, investigation and study made by itself and in its behalf, and after due consideration of all evidence and reports offered at said hearing, does find and determine the following facts: 1. That the petitioner proposes waivers of the following to expand an existiny motel: ~ SECTiONS 18.G6.050.0232, - Minimum number of parking spaces .18.06.050.024 (137 spaces required; 98 spaces AND 18.48.066.050 proposed) 2. That the above-mentioned waivecs are hereby granted on the basis that the petitioner submitted a parking study st~owing and the Planning Commission determined that the parking variance will not cause an increase in traffic congestion in the immediate vicinity nor adversely affect any adjoining land uses; and that the granting of the parking variance under the conditions imposed, if any, will not be detrimental to the peace, health, safety oc general welfare of the citizens of the City of Anaheim. 3. That no one indicated their presence at said public hearing in opposition; and that no correspondence was received in oppo~ition to subject petition. PC83-101 #06~19I ~ r ENVIF.ONMENTA.L I[dPACT [~INDING: That the Anaheim City Planning Commission has reviewed the proposal to expand an existing mote?. with waiver of minimum number of parking spaces on an irregularly-shaped parcel of land consisting of approximately 1.6 acres having a frontage of approximately 180 feet on the w~st side of Harbor Boulevard, and located approximately 185 feet south of the centerline of Vermont Avenue, and further described as 921 South Harbor Boulevard (Sandman Inn); and does heceby approve the Negative Declaration from the requirement to prepare an environmental impact report on the basis that there would be no significant individual or cumulative adverse environmental impact due to the approval of this Ne9ative Declaration since the Anaheim General Plan designates the subject property for commercial recreation land uses commensurate with the propesal; that that Init-al Study submitted by the petitioner indicates no significant individual or cumulative adverse environmental impacts; and that the Negative Declaration substantiating the focegoing findings is on file in the City of Anaheim Planning Department. NOW, THEREFORE, BE IT RES9~:'ED that the Anaheim City Planning Commission does hereby grant subject Petition for Variance, upon the following conditions which are hereby found to be a necessary prFrequisite to the proposed use of the subject property in order to preserve the safety and general welfare of the Citizens ~f the City of Anaheim: 1. That prior to issuance of a building permit, a 6-foot high masonry block wall shall be constructed along the north, west and south property line(s) and/or that a bond in an amount and form satisfactory to the City of Anaheim shall be posted with the City to guarantee the installation of said wall prior to final building inspection. 2. That subject property shall be developed substantially in accordance with plans and specifications on file with the Citp of Anaheim marked Revision No. 1 of Exhi.bit Nas. 1 through 4. 3. That prior to final building and zoning inspections, Condition Nos. 1 and 2, above-mentioned, shall be complied with. BE IT FURTHER RESOLVED that the Anaheim City Planning Commission does hereby find and determine that adoption of this Resolution is expressly predicated upon applicant's compliance with each and all of the conditions hereinabove set forth. Should any such condition, or any part thareof, be declared invalid or unenforceable by the final judgment of any court of competent jurisdiction, then this Resolution, and any approvals herein contained, shall be deemed null and void.
