AND MARGARE: A. HAWLEY, 904 West 8roadway, Anaheim, California 92805, owners of certain real propetcy situated in the City of Anaheim, County of orange, State of California, described as: LOTS 3 AND 4 IN BLUCK "B" OF TRACi NO, 23& AS PER MAP THEREOF RECORDED IN BOOK 13~ ?AGE 23, MISC~;LLANEOUS MAPS, RECORDS OF SAID Cr)~NZY, EXCEPT TN.EREFROM THE EASTERLY 8.6 FEET OF LOT 3. WHEREAS, the City Planning Commission did hold a public hearing at the Civic CentPr in the City of Araheim an June 13, 1983, at 1:30 p.m., notice of said public hearing having been duly given as requiced by law and in accordance witl~ the provisions of the Anaheim Municipal Code, Chapter 18.Q3, to heac and consicier evidence for and against said propcsed conditional use permit an~l to investigate and make findinas ~nd recomr~endations in connection theres:itlt; and WHEREAS, said Commission, after due inspection, investigation and study made by itself and in its behalf, and after due consideration of all evidence and reports offered at said hearing, does find and determine the following facts; 1• That the proposed use is properly one for which a conditional use permit is authorized by Anaheim Municipal Code Section 18.03.030.010 to wit: ta nermir ~ ~c~ 3r,d LCeuf.LdsE inn in the RM-2400 Multiple-Family) Zone. That the traffic general-.ed t~y the proposed use will not impose an undue burden upon the streets and highways designed and im~roved to carry the traffic in the area. 8. That 12 persons indicated their presence at said public hearing in opposition; and that no correspondence was received in opposition to the subject petition. ENVIRUNMENTAL IMPACT FINDING: That the Anaheim City Planning Commission has reviewed the proposal to permit a bed and breakfast inn in the RM-2400 (Residential, Multiple-Family) Lone on a rectangularly-shaped parcel of land consisting of approximately 0.4 acre located at the southeast cornet of Broadway and Indiana Stceet and further described as 904 West Broadway; and does hereby approve the Negative Declaration from the requirement to pcepare an environmental impact report on the basis that there would be no significant individual or cumulative adverse environmental impact due to the approval of this Negative Declaration since thE Anaheim General Plan designates the subject property for low-medium densi*_y residential land uses commensurates with the proposal; that no sensitive environmental impacts are involved in the proposal; that the Initial Study submitted by the petitioner indicates no significant individual or cumulative adverse environmental impacts; and that the Negative Declaration substantiating the foregoing findings is on file in the City of Anaheim Planning Pepartment. NOW, THEREI'ORE, BE IT RESOLVED that the Anaheim City~ Planning Commission does hereby yrant subject Petition for Conditional Use Permit, upon the following conditions which are hereby found to be a necessary prerequisite to the proposed use of the subject property in order to pre~erve the safety and general weltare of the Citizens of the City of Anaheim: 1. That the existing structure shall be brought up to the minimum standards of the City of Anaheim, including the Uniform Building, Plumbing, Electrir,al, Housing, MPChani.cal and Fire Codes as adopted by ~he City of Anaheim. 2. That this bed and breakfast inn shall be subject to compliance with Chapter 2.12, Transient Occupancy Tax of the Anaheim Municipal Code, requiring the collection of a transient occupancy tax. 3. That subject property shall be developed substantially in accordance with plans and specifications on file with the City of Anaheim marked Exhibit Nos. 1 aad 2; provided, however, that there shall be no exkerior advertising signs of any type on the premises. 4. That prior to final building and zoning inspections, Condition Nos. 1 and 3, above-mentioned, shall be complied with. 5.
