PC&3-126 A RESOLUTION OF THE ANAHEIM CITY PLANNING COMMISSION THAT PETITION EOR CONDITIONAL USE PERMIT NO. 2470 BE DENIEll WHEREAS, the Anaheim City Planning Commission did receive a verified Petition for Conditional Use Permit from CHRISTIAN CENTER CHURCH OF ORANGE COUNTY CALIFORNIA, 10 West Freedman Way, Anaheim, California 92802, owner, and FIRST CHURCH OF THE NA7.ARENE, 1340 North Candlewood Street, Anaheim, California 92805, agent of certain real property situated in the City of Anaheim, County of Oeange, State of California, described as: THE SOUTH E?ALF OF THE NORTHWEST QUARTER OF THE NORTHWEST QUARTER OF THE SOUTHWEST QUARTER OF SECTION 2~ TOWNSHIP 4 SOUTH~ RANGE 10 WEST, IN THE R~t:CHO SAN JUAN CAJON DE SANTA ANA, CITY OF ANAHEIM, COUNTY OF ORANGE, STATE OF CALIFORNIA, AS PER MAP RECORDED IN BOOK 51 PAGE 10 OF MISCELLANEOUS MA2S, IN THE OFFICE OF THE COUNTY RECORDER OF SAID COUNTY. WHEREAS, the City Planninq Commission did hold a public hearing at the Civic Center in the City of Anaheim on July 11, 1983 at 1:30 p.m., notice of said public hearing having been duly given as required by law and in accordance with the provisions of the Anaheim Municipal Code, Chapter 18.03, to hear and consider evidence for and against said proposed conditiona'_ use permit and to investigate and make fir,dings and recommendations in connection therewith; and WHEREAS, ~aid Commission, after due ?nspection, investigation and study made by itself and in its behalf, and after due consideration of all evidence and reports offered at said hearing, does find and determine the following facts: 1. That the proposed u.^,e is pro~erly one for which a conditional use permit is authorized by Anaheim Municipal Code Sectior. 18.21.050.270 to wit: to permit a private pre-school with a maximum enrollment of 100 students in an existing ahurch facility. 2. That one opposition; and that person indicate8 his presence ar. said public n hearing in ':'; subject petition. o correspondence was received in opposition to the ENVIRONMENTAL IMPACT FINDING: That the Anaheim City Planning Commission has reviewed the ocoposal to permit a private pre-schocl with a maximum enrollment of 100 ~udents in an existing church facility on an irregularly-shaped parcel o,. land consisting of apprcximately 2.1 acres located at the northerly ter~inus of Norwood Street and Candlewood Street, approximately 390 feet north of the centerline of Kenwood Avenue and further described as 1340 North Candlewood Street; and does hereby disapprove the Negative Declaration from the requirement to prepare an environmental impact report on the basis that there would be significant individual or cumulative adverse environmental impacts involved in this oroposal; and that an environmental impact report would be required prior to approval of this project. NOW, THEREFdRE, BE IT RESOLVE~ that the Anaheim City Planning Commission does hereby deny subject Petition for Conditional Use Permit, on the basis of the aforementioned findings. That the size and shape of the site proposed for the use is not ade uate to allow the full development of the proposed use in a manner not detr3mental to the pacticular area nor to the peace, health, safety ,and general welfare ~f the Citizens of the City of Anaheim. \ 4. That the granting of the Conditional Use Permit under the conditions imposed, if any, will be detrimental to the peace, health, safety and general welfare of the Citizens of ttie City of Anaheim. 5. That the traffic generated by the proposed use will impose an undue burden upon the streets and highways designed and improved to carry the traffic in the area. 6.
