PC83-I29 RESOLUTION OF THE ANAHEIM ~~ITY PLAN~ING COMMISSION THAi' PETZ'PION FOR VARIANCE NO. 3341 BE DENIED WHEREAS, the Anaheim City Planning Commission did receive a verified Petition for Variance from CONRAD J. LETTER & JOSEPHINE M. LETTER, 3107. Vallejo Drive, Anaheim, CaliEornia 92804, owners, and WALTER K. BOWMAN, 7936 Cerritos Avenue, Stanton, California 90680, agent of certain real property situated in the City of Anaheim, County of Orange, State of California described as: THAT PORTION OF LOT OF LOT 1 OF THE ANAHEIM EXTENSION AS SHOWN ON A MAP OF SURVEY MADE BY WILLIAM HAMEL AND FILED FOR RECORDING IN THE OFFICE OF THE COUNTY RECORDER OF LOS ANGELES COUNTY, CALIFOR[dIA JESCRIBED I15 FOLLOWS: BEGINNING AT A POINT IN THE NORTH LINE OF SAID LOT BEING IN THE SOOTH LINE OF LA PALMA AVENUE, DI5TANT THEREON 255.33 FEET WEST OF THE NORTHEAST CORNER OF SAZD LOT RUNNING THENCE WEST ALONG THE NORTH LINE OF SAID LOT 79.91 FEET~ THENCE SOUTH PARALLEL WITH THE EASTERLY LINE OP SAID LOT 302.23 FEET THENCE NORTH 73 DSGREES 54' 25" EAST 77 FEET TO A LINE WHICH IS PARALLEL WITH THE EASTERLY LINE OF SAID LOT THRU A POINT OF BEGINNING. SAID LAND IS SHOWN ON A LICENSED SURVEYORS MAP FILED IN BOOK 16, PAGE 9 OF RECURD3 OF SURVEY ZN THE OFFICE OF THE COUNTY RT:CORDER OF SAID COUNTY. WHEREAS, the City Planning Commission did hold a public hearing at the Civic Center in the City of Anaheim on June 27, 1983, at 1:30 p.m., notice of said Qublic hearing having been duly given as r~quired by la.~ and in accordance with the provisions of the Anaheim M;;nicipal Code, Chapter 18.03, to hear and consider evidence for and against ssid proposed variance and to investigate and make findings and recomme::dz;iions in connection therewith; said publ.ic hearing having been continued tc che Planning Commission meeting of July 25, 1983; and A'HEREAS, said Commission, after due inspection, investigation and study made by itself and in its behalf, and after due consideration of. all evidence and reports offered at said hearing, does find and determine the follo~vinq facts: 1. That the p?titioner proposes waivers of the following to construct an 8-unit affordable condominium complex: (a) SECTION 18.31.061.012 - Minimum lot area per dwellinq unit. (3000 sq. ft. required; 2570 sq. ft. proposed) (b) SGCTION 18.31.063.G11 - Minimum landscaped setback. (15 ft. required; 9 ft. proposed) ~0002r PC83-129 R ,--. ~~ (c) SECTION 18.31.063.031 - Minimum recreational-leisure area. (1000 sq. ft. per unit required; 911 sq. ft. proposed) (d) SECTION 18.06.050.0121 - t4inimum number of parkin9 spaces. AND 18.31.066.010 (20 spaces required; 19 spaces proposed) 2. That the above-mentioned waivers are hereby denied on the basis that the petitioner demonstrated that a hardship exists in that no unia,ue circumstances pertaining to the size, shape, topography, location or surroundings of subject prope:ty were demonstrated which would deprive the property of privileges enjoyed by other pcoperties in the ~ame zon~ and vicinity. 3. That there are no exceptional or extraordinary circumstances or conditions applicable to the property involved or to the intended use of the property that do not apply generally to the property or class of use in the same vicinitp and zone. 4. That the requested variance is not necessary for the preservation and enjoyment of a substantial property righE possessed by other property in the same vicinity and zone, and denied to the property in question. 5. That the requested variance will be materially detrimental to the public welfare or injurious to the property or improvements in such vicinity and zone in which the property is located. 6. That no one indicated their presence at said public hearing in opposition; and that no correspondence was received in opposition to subject petition. ENVIRONMENTAL IMPACT FINDING: That the Anaheim City Planning Commission has reviewed the proposal to consttuct an 8-unit affordable condominium complex with waivers of minimum lot area oer dwelling unit, minimum landscaped setback, minimum recreational-leisure area and minimum number of parking spaces on an irregularly-shaped parcel of land consisEing of approximately 0.47 acre, havinq a frontage of approximately 80 feet on the south side of La Palma Avenue and fucther described as 1260 East La Palma Avenue; and does hereby approve the Negative Declaration from the requirement to prepare an environmental impact report on the basis that there would be no significant individual or cumulative adverse environmental impact due to the approval of this Negative Declaration since the Anaheim General Plan desiqnates the subject property for medium density residential land uses commensurate with the proposal; that no sensitive environmental impacts are involved in the proposal; that the Initial Study submitted by the petitioner indicates no significant individual or cumulative adverse environmental impacts; and that the Negative Declaration substantiating the foregoing findings is on file in the City of Anaheim Planning Departrnent.
