PC83-130 A RESOLUTION OF THE ANAHEIFI CITY PLANNING COMMZSSION THAT PETITION FOR CONDITIONAL USE PERMIT NO. 2465 BE GRANTED WHEREAS, the Anaheim City Planning Commission did re~eive a verified Petition for Conditional Use Permit from NATHAN OGINTS, ET ~L., 3481 La Sombra Drive, Los Angeles, California 90068, owner, and BANK OF ANAHEIM N. A., GERALD R. BUSHORE, DIRECTOR, 702 West Lincoln Avenue, Anaheim, California 92805 and DAVIS TAYLOR, 2114 West Ball Road, Anaheim, California 92804, agents of certain real property situated in the City of Anaheim, County of Orange, State of California, described as: THAT PORTION OF LOT 1 OF TRACT 2090, AS PER MAP RECORDED IN BOOK 61~ PAGES 38 AND 39 OF MISCELLANEOCS MAPS, IN TEiE OFFICE OF THE COUNTY RECORDER OF ORANGC COUNTY, CALIFORNIA, DESCRIBED AS FOLLOWS: BEGINNING AT A POINT ON THE EASTERLY LINE OF SAID LOT 1 DISTANT NORTH 17° 22' S5" WEST 204.24 FEET FROM THE SOUTHEAST CORNER THEREOF; THENCE SOUTH 89° 55' 35" WEST 190.98 FEET; THENCE NORTH 0° 13' 40" WEST 165.00 FEET TO THE NORTHERLY LINE OF SAID LOT; THENCE ALONG SAID NORTHERLY LINE NORTH 89° 55' 35" EAST 128.96 FEET TO THE BEGINNING OF A TANGENT CURVE CONCAVE TO THE SOUTHWEST HAVING A RADIUS OF 15 FEET; THENCE SOUTHEASTERLY 19.03 FEET ALONG SAID CURVE TQ THE EASTERLY LINE OF SAID LOT; THENCE ALONG TIiE EASTEP.LY LINE SOUTH 17° 22' 55" EAST 161.79 FEET TO THE POINT OF BEGINNING. WHEREAS, the City Planning Commission did hold a public hearing at the Civic Center in the City of Anaheim on July 11, 1983, at 1:30 p.m., notice of said public hearing having t,een duly given as required by law and in accordance with the provisior.s of the Anaheim Municipal Code, Chapter 18.03, ta hear and consider evidence for and against said proposed conditional use permit and to investigatF and make findings ar:d recommendations in connection th~~rewith; said public hearing having been continued to the Planning Commission meeting of July 25, 1983; and WHEREAS, said Commission, after due insgection, investigation and study made by itself ~nd in its behalf, and after ~9ue consideration o£ all evidence and reports offered at said hearing, does Find and determine the following facts: 1, That the proposed use is properly one for which a conditional use permit is authorized by Anaheim Municipal Code Section ].8.03.030.010 to wit: to permit a temoorary office trailer for a bank. 2. That the proposed use will not adverse?.y affect the adjoining land uses and the growth and devPlopment of the area in which it is proposed to be located. That the size and shape of the site proposed for the use is adequate to allow the full development of the proposed uUe in a manner not detrimental to the particular area nor to the peace, heall-h, safety and general welfare of the Citizens of the City of Anaheim. 4. That the granting of the Conditional Use Permit under th e conditions imposed, if any, will not be detrimental to the peace, health, safety and general welfare of the Citizens of the City of Anaheim. 5. That the traffic generated by the proposed use will nc~ impose an undue burden upon the streets and highways designed and improved to carry the traffic in the area. 6. That no one indicated their presence at said public hearing in opposition; and that no correspondence was received in opposition to the subject petition. ENVIRONMENTAL IMPACT FINDING: That the Anaheim City Planning Commission has reviewed the proposal to permit a temporary trailer for a bank on an irregularly-shaped parcel of land consisting of approximately 0.64 acre located at the southwest corner of Ball Road and Anaheim Boulevard; and does hereby aPProve the Negative Declaration from the requirement to prepare an environmental impact report on the basis that there would be no significant individual or cumulative adverse environmental impact due to the approval of this Negative Declaration since the Anaheim General Plan designates the subject property for general commercial land use^ commensurate with the proposal; that no sensitive environmental impacta are involved in the proposal; tliat the Initial Study submitted by the petitioner indicates no significant individual or cumulative adverse environmental impacts; and that the Negative Declaration substantiating the foregoing findings is on file in the City of Anaheim Planning Department. NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planning Commission does hereby grant subject Petition for Conditional Use Permit, upon the following conditions which are hereby found to be a necessary prerequisite to the proposed use of the subject property in order to preserve the safety and general welfare of the Citizens of the City of Anaheim: 1. That the owner of subject property shall pay to the City of Anaheim a fee for street lighting along Ball Road and Anaheim Bouleva~d in an amount as determined by the City Council. 2. That prior to issuancE of a building permit, the appropriate traffic signal assessment fee shall be paid to the City of Anaheim in an amount as determined by the City Council for new commercial buildings and trailers. 3. That the owner of subject property shall, by recorded deed, shall irrevocably offer to deed to the City of Ar.aheim a strip of land 53 feet in wioth from the centerline of the street along Ball Road and Maheim Boulevard for street widening purposes. 4. That drair.age of subject property shall be dispos~d of in a manner satisfactory to the City Engineer. -Z PC83-130 5. That prior to issuance of building permits, the proposed driveway locations shall be reviewed and approved by the City Traffic Engineer. 6. That trash storage areas shall be provided in accordance with approved plans on file with the Street Maintenance and Sanitation Division. 7. That plans sha11 be submitted to the Building Division showing compliance with the minimum standards of the City of Anaheim, including the Uniform Building, Plumbing, Electrical, Mechanical and Fire Codes as adopted by the City of Anaheir. The appropriate permits shall be obtained for any necessary work. 8. That subject propecty shall be developed substantially in accordance with plans and specifications on file with the City of Anaheim marked Exhibit No.1. 9. That prior to the commencement of the activity authorized under this resolution, or prior to the time that a building Fermit is issued, or within a period of one year from the date of this resolution, whichever occurs first, Condition Nos. 1, 3, and 11, above-mentioned, snall be complied with. Fxter.sions for further time to complete said conditions may be granted in accordance with Section 18.03.090 of the Anaheim Municipal Code. 10. That prior to final building and zoning inspections, Conditions Nos. 4, 6, and 8, above-menl-ioned, shall be complied with. 11. That the owner of subject property shall submit a lettec requesting termination of Variance Nos. 315 an~ 482 and Conditional Use Permit I~o. 1617 to the Planning Department. BE IT FURTHER RE50LVED that the Anaheim City Planning Commission does heceby find and determine that adoption of this Resolution is expressly predicated upon applicant's compliance with each and all of the conditions hereinabove set forth. Sh~uld any such conditions, or any part thereof, be declared invalid or unenforceable by the final judgment of any court of competent jurisdiction, then this Resolution, and any approvals herein contained, shall be deemed null and void.
