A RESOLUTION OF THE ANAHEIM CITY PLANNING COMMISSION
AMENDING RESOLUTION NO. PC 83-119~ NUNC Pk0 TUNC, IN COP7NECTIODI WIPH
CONDITIONAL USE PERMIT NO. 2458
WHEREAS, un June 27, 1983, the Anaheim City Planr.ing Commission
granted Conditional Use Permit No. 2458 , In Part, ~esolution No. PC83-119, to
permit a 94-unit senior citizens a partment complex in the RM-1200
(Residential, Multiple-Family) Zone on a rectangularly-shaped parcel of land
consisting of approximately 2.33 acres, having a frontage of approximately 280
feet on the east side of Gilbert Street, and further described as 950 South
Gilbert Street; and
WHEREAS, Condition No. 13, page 4, is incomplete and presently
reads, "That the owner of subject property shal.l. record a covenant requiring
that the occupancy of these senior citizens uni~s shall be limited to at least
one person being no less than sixt}• (60) years of age an:l that the complex
shali be maintained for senior citizen housing f or a period of no less than
thirty (30) years. The form and content of said covenar.t shall be reviewed
a nd approved by the City Attorney's Office prior to recordation."; and
WHEREAS, this paragraph should have included the words "per dwelling
unit."
NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planning
Commission does he:eby amend Resolution No. PC83-119, nunc pro tunc, in
c onnection with Conditional Use Permit No. 2458, amending Condition No. 13 to
read as follows:
13. "That the owner of subject property shall record a covenant
reauirina that the occupancy oE these senior citizens units
shall be limited to at least one pe*son per dwelling unit being
no less than sixty (60) years of age and that the complex shall
be maintained for senior citizen housing for a perioc~ of no
less than thirty (30 ) years. The form and content of said
covenant shall be reviewed and approved by the City Attorney's
Office prior to recordation."
THE FOREGOING kCSOLUTION is signed and approved by me this 25th ay
