CONTAINING AN AREA UF U.35 ACRES, MORE OR LESS. #0028r PC83-155 ~,, WHEREAS, L•he City Planning Commission di@ hold a public hearing at the Civic Center in the City of Anaheim on September 7, 1983 at 1:30 p,m., notice of said public hearing having been duly given as required by law and in accorrJance with the provisions of the Anaheim Municipal Code. Chapter 18.03, to hear and consider evidence for and against said proposed reclassification and to investigate and make findings and recommendations in connection therewith; and WHEREAS, said Commission, after due inspection, investigation and study made by itself and in its behalf, and after due consideration of. all evidence and reports offered at said hearing, does find and determine the following facts: 1. That the petitioner proposes reclassification of subject pzoperty from the CG (Commercial, General) zone to the CL (COmmercial, Limited) Zone to construct a 2-story commercial office building. 2. That the Anaheim General Plan designates subject property for general commercial and/or medium density residential land uses. 3. That the proposed reclassification of subject property is necessary and/or desirable for the orderly and proper development of the community. 4. That the proposed reclassification of subject pruperty does properly relate to the zones and their permitted uses locally established in close proximity to subject property and to the zones and their permitted uses generally established throughout the community. 5. That the proposed reclassification of subject property requires the improvement of abutting streets in accordance with the Circulatiun ElEmert of che General Plan, due to the anticipated increase in traffic which will be generated by the intensification of land use. 6. That no one indicated their presence at said public hearing in opposition; and that .^.o correspondence was received in opposition to subject petition. ENVIRONMENTAL IMPACT FINDING: That the Anaheim City Planning Commission has reviewed the proposal to reclassify subject property from the CG (COmmercial, General) 2one to the CL {Commercial, Limited) Zone to construct a 2-story commercial office building on an irregularly-shaped parcel of land consisting of approximately 0.35 acre located at the southwest corner of Chestnut Strpet and Harbor Boulevard; and does hereby approve the Negative Declaration upon finding that it has considered the Negative Declaration together with any comments received during the public review process and further finding on the basis of the initial study and any comr~ents received that there is no substantial evidence that the project will have a significant effect on the environment. ~2 PC83-155 NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planning i Commission does hereby grant subject Petition for Reclassification and, by so doing, that Title 18-Zoning of the Anaheim Municipal Code be amended to exclude the above-described pzoperty from the CG (Commercial, General) Zone to the CL (Commercial, Limited) Zone and to incorporate said described property into the CL (Commercial, Limxted) Zon~ upon the following conditions which are hereby founo tu be a necessary prere~uisite to the proposed use of subject property in order to preserve the safety and general welfare of the Citizens of the City of Anaheim: 1. That the building shall be fire sprinklered as required by the City of Anaheim Fire Uepartment. Z• That street lightin9 facilities along Chestnut Street sh~ll be modified as required by the Utilities General Manager in accordance ~ith specifications on file in the Office of Utilities General Manager, and that security in the form of a bond, certificate of deposit, letter of credit, or cash, in an amount and form satisfactory to the City of Anaheim, shall be posted with the City to guarantee the satisfactory completion of the above-mentioned improvements. Said security shall be posted with the City of Anaheim prior to approval of building permits. The above-required improvements shall be installed prior to occupancy. 3• That subject property shall be developed substantially in accordance with plans and specifications on file with the City of Anaheim marked Exhibit Nos. 1 through 4. 4• That prior to final buildii.g and zoning inspections, Condition Nos. 1 and 3, abov?-mentioned, shal.l be complied with. BE IT FURTHFR RESOLVED that tt~e A~idYlE1R1 City Planning Commission does hereby find and determine that adoption of this Resolution is expressly p~edicated upon applicant's compliance with each and all of the conditions hereinabove set forth. S~ould any such condition, or any oart thereof, be declared invalid or unenforceable by the final judgment of any court of competent jurisdiction, then this Resolution, and any approvals herein contained, shall be deemed null and void.
