PC83-166 A RESOLUTION OF THE ANAHEIM CITY FLANNING COMMISSION THAT P~TITION FOR VARIANCE N0. 3347 BE GRANTED WHEREAS, the Anaheim City Plannin9 Commission did receive a verified 9etition for Variance from ROBERT M. AND CONSTANCE S. ROSSO, 1100 Clifpark Circle, Anaheim, California 92805, owner.s of certain real property situated in the City of Anaheim, County of Orange, State of California described as: LOT 16 OF TRACT NO. 6812 AS PER MAP RECORDED IN BOOK 258~ PAGES 18, 19~ AND 20 OF MISCELLANEOUS MAPS, IN THE OFFICE OF THE RECORDER OF SAID COUNTY. WHEREAS, the City Planning Commission did hold a public hearing at the Civic Center in the City of Anaheim on September 19, 1983, at 1:30 p.m., notice of said public hearing having been duly given as required by law and in accordance with the provisions of the Anaheim Municipal Code, Chapter 18.03, to hear and consider evidence for and against said proposed variance and to investigate and make findings and recommendations in connection therewith; and WHEREAS, said Commissioa, after due inspection, investiqation and study made by itself and in its behalf, and after due consideration of all evidenee and reports offered at said heacing, does find and detecmine the following facts: 1. Petitioner requests waivec of the folZowing to retain a garage conversion: SECTION 18.06.050.011 - Minimum number and type of arking spaces AND 18.27.066.010 (4 spaces (2 enclosed in a garage) required; 3 spaces (1 enclosed in a garage) existing) "L. That ti,e above-mentioned waiver is hereby ;ranted on the basis that the parking variance will not cause an increase in traffic congestion in the immediate vicinity nor adversely affect any adjoining land uses; and that the granting of the p3rking variance under the conditions imposed, if any, will not be detrimental to the peace, health, safet.y or general welfare of the citizens of the City of Anaheim. 3. That no one indicated their presence at said public hearing in opposition; and that no correspondence was received in opposition to subject petition. ENVIRONMENTAL IMPACT FINDING: The Planning Director or his authorized repcesentative has determined that the proposed project falls within the definition of Categorical Exemptions, Class 3, as defined in the State EIR Guidelines and is, therefore, cate9orically exempt Erom the requirement to prepare an EIR. NOW, THEREEORE, BE IT RESOLV~:ll that th° Anaheim City Planning Commiss~on does hereby grant subject Petition for Variance, upon the followinq conditions which are hereby found to be a necessary prerequisite to the ~,roposed use of the subject property in orde: to preserve the safety and general welfare of the Citizens of the City of Anaheim: #0041r PC83-166 ~i^ 1. That subject property shall be developed substantially in accordance with plans and specifications on file with the City of Anaheim marked Exhibit No. 1. 2. That plans shall be submitted L-o the Building Division showing compliance with the minimum standards of the City of Anaheim, including the Uniform Building, Plumbing, Electrical, Housing, Mechanical and Fire Codes as adopted by the City of Anaheim. The appropriat? permits sha11 be obt•ained for any necessary work. 3. That the existing structure shall be brought up to the minimum standards of the City of Anaheim, including the Uniform Building, Plumbing, Electrical, Housing, Mechanical and Fire Codes as adopted by the City of Anaheim. 4. That prior to final buildino and zoning inspections, Condition Nos. 1, 2 and 3, above-mentioned, shall be complied with. BE IT FURTHER RESOLVED that the Anaheim City Planning Commission does hereby find and determine that adoption of this Resolution is expressly predicated upon applicant's compliance with each and all of the conditions hereinabove set forth. Should any such condition, or any part thereof, be declared invalid or unenforceable by the final judgment of any court of competent jurisdiction, then this Resolution, and any approvals herein contained, shall be deemed r,ull and void.
