PC83-174 A RESOLUTION OF THE ANAHEIM CITY PLANNING COMMISSION THAT PGTITION FOR RECLASSIFICATION NO. 83-84-3 BE GRANTED WEiEREAS, the Anaheim City Planning Commission did receive a verified petition for Reclassification from JAMES D. PIERCE AND HELEN M.. PIERCE, 401 South Euclid St[eet, Anaheim, California 92802, owners of certain real prooerty Si'~~ated in the City of Anaheim, County of Orange, State of California~ ~escribed as follows: LOT 72 OF TRACT N0. 2402~ AS SHOWN ON A MAP RECORDED IN BOOK 79, PAGES 37, 38~ AND 39 OF MISCELLANEOUS MAPS~ RECORDED IN THE OFFICE OF THE COUNTY RECORDER OE SAID COQNTY. WHEREAS, the City Planning Commission did hold a public hearing at the Civic Center in the City of Anaheim on September 7, 1983 at 1:30 p.m., notice uf said public hearing having been duly given as required by law and in accordance with the provisions of the Anaheim Municipal Code. Chapter 18.03, to hear and consider evidence for and against said proposed reclassification and to investiqate and make findings and recommendations in connection therewith; said public hearing having been continued to the Planning Commissio~ meeting of October 3, 1983; and WHEREAS, said Commission, after due inspection, investigation and study made by itself and in its behalf, and after due consideration of alI evidence and reports offered at said hearing, does find and determine the following facts: 1. That the petitioner proposes reclassification of subject property from the RS-7200 (Residential, Single-Family) Zone to the CO (COmmercial, OEtice and Professional) Zone. 2. That the Anaheim General Plan designates subject property for general commercial land uses. 3. That the proposed reclassification of subject property is necessary and/or desirable for the orderly and ptoper development of the community• 4. That the proposed reclassification of subject property does properly relat_e to the zones and their permitted uses locally established in close proximity to subject property and to the zones and their pecmitted u:,es generally established throughout the community. 5. That the proposed reclassifir,ation of subject property requires the imptovement of abutting streets in accordance with the Circulation Element of the Genecal Plan, due to the anticipated increase in traffic which will be generated bY the inte:~sification of land use. 6. That no one indicated their presence at said public hearing in opposition; and that no correspondence was received in opposition to subject petition• #0048r PC83-174 ENVIRONMENTAL ZMPACT FINDING: That the Anaheim City Planning Commis~ion has reviewed the pcoposal to reclassify subject property fcom the RS-72U0 (Residential, Single-Family) Zone to the CO (Commercial, Office and Pro£essional) Zane to permit commercial use of a residential structure with waivet of minimum number of parking spaces on a rectangularly-shaped parcel of lai~d ~onsistinq of approximately 680Q square feet having a Erontage of approximately 68 feet on the west side of Euclid Street, and further described as 401 South Euclid Street; and does hereby approve the Negative Beclaration upcn finding that it h~s considered the Negativ• Declaration together with any comments reccived during the public review process and further finding on the basis of the Initial Study and any comments received that thece is no substantial evidence that the project will have a significant effect on the environment. NQW, THER~I'ORE, BE IT RESOLVED that the Anaheim City Planning Commission does hereby grant subject Petition for Reclassification and, by so doing~ that Title 18-Zoning of the Anaheim Municipal Code be amended to exclude the above-described property from the RS-7200 (Residential, Single-Family) Zore and to incorporate said described property into the CO (Commercial, Office and Professional) Zone upon the following conditions which are hereby found to be a necessary prerequisite to the proposed use of subject propetty in order to preserve the safety and general welfare of the Citizens of the City of Anaheim: 1• That the owner of subject property shall pay to the City of Anaheim a fee for street lighting along Euclid Street in an amount as determined by the City Council. 2. That the owner of subject pcoperty shall pay to the City of Anaheim a fee for tree planting purposes along Euclid Street in an amount as determined by the City Council. 3. That p:ior to the in~roduction of an ordinance rezaning subject property, Condition Nos. 1 ar.d 2, above-mentioned, shall be completed. The provisions or rights granted by this resolution shall become null and void by action of the Planning Commission i.tnless said conditions are complied with within one year from the data of this resolution, or such further time as the PZanning Commission may grank. BE IT FURTHER RESOLVED that the Anaheir City Planning Commission does hereby find and determine that adoption of this Resolution is expcessly predicated upon applicant's compliance with each and all of th~ cunditions hereinabove set forth. Should any such rondition, or any part thereof, be declated invalid or unenforceable by the final judgement of any court of competent jurisdiction, then this Resolution, and any approvals herein contained, shall be deemed null and void.
