WEiEREAS, the City Planning Commission did hold a public hearing at the Civic Center in the City of Anaheim on October 3, 1983, at 1:30 p.m., notice of said public hearing having been duly given as requited by law and in accordance with the provisions of the Anaheim Municipal Code, Chapter 18.03, to hear and consider evidence for and against said proposed conditional use permit and to investigate and nake findi~gs and recommendations in connection therewith; and WHEREAS, said Commission, after due inspection, investiqation and study made by itself and in its behalf, and after due consideration of all evidence and reports offeced at said hearing, does find and determine the following facts: 1. That the prcposed use is properly one for which a conditional use permit is authorized by Anaheim Municipal Code Section 18.44.050.160 to wit: to permit construction of a 4-~tory, 60-unit motel. 2. 'Phat the proposed use will not adversely affect the adjoining land uses and the growth and development of the area in which it is proposed to be located. 3. That ~:~e size and shape of the site proposed for the use is adequate to allow the full development of the proposed use in a manner not detrimental to the particular area nor to the peace, health, safety and general welfare of the Citizens of the City of Anaheim. 4. That the granting of the Conditional Use Permit under the conditions imposed, if any, will not be detrimentsl to the peace, health, saf•ety and genera]. welfare of the Citizens of the City of Anaheim. 5. That the traffic generated by the proposed use will not impose an undue burden upon the streets and highways designed and improved to carry the trafEic in the area. 6. That Eour persons indicated their presence at said public hearing in opposition; a~t~ that no correspondence was received in opposition to the subject petition. -3- PC83-180 ~ ~ ENVIRONMENTAL IMPACT FINDING: That the Anaheim City Planning Commission has reviewed the proposal to reclassify Parcel 1 of subject property from the RS-A-43,000 (Residential, Agricultural) to the CL (Commercial, Limited) Zone and Parcel 2 from the RM-1200 (Residential, Multiple-Family) Zone to the CL (COmmercial, Limited) Zone to permit construction of a 4-story, 60-unit motel on Parcel 1, a rectangularly-shaped parcel of land consisting of approximately 0.48 acre located at the southeast corner of Stonybrook Drive and Beach Boulevard and further described as 736 South Beach Boulevard and Parcel 2, a rectangularly-shaped parcel of land consisting of approximately 0.16 acce, having a frontage of approximately 109 feet on the south side of Stonybrook Drive, approximately 275 feet east of the centerline of Be3ch Boulevard and further described as 2966 Stonybrook Drive; and does hereby approve the Negative Declaration upon finding that it has considered the Negative Declaration together with any ~omments received during the public review process and further finding on the basis of the initial study and any ~omments received that there is no substantial evidence Ehat the project will have a significant effect on the en~~ironment. NOW, THEREEORE, BE IT RESOLVED that the Anaheim City Planning Commission does hereby grant subject Petition for Conditional Use Permit, upon the following conditions which are hereby found to be a necessary prerequisite to the proposed use of the subject proper~y in crdet to preserve the safety and general welfare of the Citizens of the City of Anaheim: 1. That this Conditional Use Permit is granted subject to the completion of Reclassification No. 83-84-8, now pending. 2. That prior to issuance of a building permit, the appropriate tra£fic signal assessment fee shall be paid to the City of Anaheim in an amount as determined by the City Council for new commercial buildings. 3. That drainage of subject property shall be disposed of in a manner satisfactory to the City Engineer. 4. That sub7ect pzopert;r ~hall be served hy underyround utilities. 5. That prior to commencement of structural framing, fire hydrants shall be installed and charged as required and determined to be necessary by the Chief of the Fire Department. 6. That trash storage areas shall be provided in accordance with approved plans on file with the Street Maintenance and Sanitation Division. 7. That the proposed driveway on Beach Boulevard shall be celocated to Stonybrook Drive as required and approved by the City Traffic Engineer. 8. That subject property shall be developed substantially in accorda~:ce with plans and specifications on file aith the City of Anaheim marked Exhibit Ncs. 1 through 6; provided, however, that kitchen efficiency units may be installed in no moce than twenty-five percent (25$) of the motel units, with a maximum of 6-cubic foot refrigerator.s, two-burner stoves excluding oven and baking facilities, and sin9le compartment sinks, except that the manager's unit will be allowed to have full kitchen facilit3es. -4- PC83-260 ~ ~ 9. That prior to final building and zoninq inspections, Candition Nos. 3, 4, 6, 7 and 8, above-menfioned, shall be complied with. BE IT FURTHER RESOLVED that the Anaheim City Planning Commission does hereby find and determine that adoption of this Resolution is expressly predicated upon applicant's compliance with each and all of the conditfons hereinabove set forth. Shauld any such conditions, or any part theceof, be declared invalid or unenforceable by the final judgment of any court of competent jurisdiction, then tnis Resolution, and any approvals herein contained, shall be deemed null and void.
