PC83-195 A RESOLUTION OF THE ANAHEIM CITY PI~ANNING COMMZSSION THAT PGTITION FOR CONDITIONAL USE PERMIT NO. 2500 BE GRANTED WHEREAS, the Anaheim City Planning Commission did receive a verified Petition for Conditional Use Permit from FRANK RAYMOND ADDIS & SHARON ANN BARTFi, 11 Southernwood, ~rvine, California 92715, owners of certain real propecty situated in the City of Anaheim, County of Orange, State of California, described as: ORIGINAL BUILDING LOT 15~ IN THE CITY OF ANAHEIM~ COUNTY l~F ORANGE~ STATE OF CALIPORNIA, AS PER MAP THEREOF RECORDED IN BOOK 4 PAGES 629 AND 630 OP DEEDS, RECORDS OF LOS ANGELES COUNTY~ CP.LIFORNIA. EXCEPT THE EASTERLY 50.25 FEET THEREOF. EXCEPT THE INTEREST IN ~3E NORTHERLY 10 FEET AND TEIE WESTERLY 20 FEET AS RESERVED FOR ALLEY PURPOSES BY THE CITY OF ANAHEIM~ IN DEED RECORDED DECEMBER 21, 1922~ IN B~OK 445 PAGE 305~ DEEDS AND AS EXCEPTED AND RESERVED IN OTHER DEEDS OF RECORD. WHEREAS, the City Planning Commission did hold a p~lblic hearing at the Civic Center in the City of Anaheim on October 3, 1983, at 1:30 p.m., notice of said public hearing having been dul.y given as required by law and in accordance with ihe provisions of the Anaheim Municipal Code, Chapter 18.03, to hear and consider evidence for and against said proposed conditional use permit and to investigate and make findings and recommendations in connection therewith; and WHEREAS, said Commission, after due inspection, investigation and study made by itself and in its behaZf, and after due consideration of all evi.dence and reports offered at said hearing, does find and determine the following facts: 1. That the proposed use is properly one foc which a conditional use permit is authorized by Anaheim Municipal Code Section 18.81.050.080 & 18.06.080 to wit: to permit a 20-unit senior citizens apartment complex in the PD-C (Parking District-Commercial) Zone wich waiver of: SECTION 18.06.050.013 - Minimum number and tvpe of parkinq spaces. (16 covered spaces required; 11 spaces: 5 covered and 6 open proposed) 2. That the proposed use is hereby granted. 3. That the requested waiver is hereby granted on the basis that the parking variance will not cause an increase in traffic co;igestion in the immediate vicinity nor adversely affect any adjoining land uses; and that the granting of the parking variance under the conditions imposed, if any, wi~~ not be detrimental tc the peace, health, safety or general welfare uf the citizens of the City of Anaheim. ~0059r PC83-185 ~`~\ 4. That the proposed use will not adversely affect the adjoining land uses and the growth and development o£ the area in which it is proposed to be located. 5. That the size and shape of the site proposed for Che use is adequate to allow the full development of the proposed use in a manner not det•rimental to the particular area nor to the peace, health, safety and general welfare of the Citizens of the City of Anaheim. 6. That the granting of the Conditional Use Permit under the conditions imposed, if any, will not be detrimental to the peace, health, safety and general welfare of the Citizens of the City of Anaheim. 7. That the traffic generated by the proposed use will not inpose an undue burden upon the streets and highways designed and improved to carry the traffic in the area. 8. That no one indicated their presence at said public hearing in opposition; and that no correspcndence was received in opposition to the subject petition. ENVIRONMENTAL IMPACT EINDING: That the Anaheim City Planning Commission has reviewed the proposal to permit a 20-unit senior citizens apartment complex in the PD-C (Parkinq District-Commercial) Zone with waiver of minimum number and type of parking spaces on a rectangularly-shaped parcel of land consisting of approximately 12,705 square feet, having a£rontage of approximately 70 feet on the north side of Cypcess Street, being located approximately 185 feet east of the centerline of Lem~n Street and further described as 12~ ~vest Cypress Street; and does hereby approve the Negative Declaration upon finding that it has considered the Negative Declaration together with any comments received during the public review process and further finding on the basis of the initial study and any comments received that there is no substantial evidence that the project will have a significant effect on the environmenl. NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planning Commissio^ does hereby grant subject Pe`ition for Conditional Ose Permit, upon the following conditions which are hereby found to be a necessary ~rerequisite to the proposed use of the subject property in order to preserve the safety and general welfare of the Citizens of the City of Anaheim: 1. That prior to issuance of a building permit, appropriale park and recreation in-lieu fees shall be paid to the City of Anaheim in an amount as determined by the City Council. 2. That prior to issuance of a building permiL•, the appropriate traffic signal assessment fee shall be paid to the City of Anaheim in an amount as determined by the City Council for each new dwelling unit. 3. That drainage of subject property shall be disposed of in a manner satiefactory to the City Engineer. 4. That the owner of subject property shall execute and record a covenant against the property restricting occupancy of the apartment units to at least one person 55 years of age or older. _2_ PC83-185 . . . ..... ~. .~,.:~,:i...~'+/.t,Y,i'f37 Pn". 5• That the developez shall obtain (by Ordinance) a parking prohibition on the north side of Cypress Street adjacent to subject property a3 required by the Streets and Sanitation Department to allow for safe trash collection. b• That subject property sha~l be developed substantially in accordance with plans and specifications on file with the City of Anaheim marked Exhibit Nos. 1 through 3. 7• That prior to the commencement of the activity authorized under this resoliition, or prior to the time that a building permit is issuec or within a period of one year from the date of this resolution, whichever occurs first, Conc?ition Nos. 4 and 5, above-mentioned, shall be complied with. Extensions for further tim~ to complete said conditions may be granted in accordance with Section 18.03.090 of the Anaheim Municipal Code. 8• That prior to final building and zoning inspeckions, Condition Nos. 3 and 6, above-mentioned, shall be complied with. BE IT FURTHER RESOLVED that the Anaheim City Planning Commission does hereby find and determine that adoption of this Resolution is expressly predicated upon applicant's compliance with each and a].1 of the conditions hereinabove set forth. Should any such conditions, or any part thereof, be declared invalid or unenforceable by the final judgment of any court of competent jurisdiction, then this Resolution, and any approvals herein contained, shall be deemed null and void.
